Four Points Of Richard Kyoto's Summons On Alleged Violation Of Copyright Hetty Koes Endang

JAKARTA - Songwriter Richard Kyoto and the legal team conveyed the four main points that made him send a subpoena to Hetty Koes Endang on suspicion of copyright infringement.

Purwadi, Richard Kyoto's attorney, said that Hetty Koes Endang had performed a client's song entitled Love' without permission, when appearing in a concert titled Konsert Satu Suara Volume 2 which was held in Kuala Lumpur, Malaysia on 7 and 8 November 2015.

"First, Hetty Koes Endang sang a song without permission from the creator," said Purwadi at a press conference in Mampang, South Jakarta on Tuesday, July 16.

"Then, the second, change some of the lyrics or lyrics of the song," continued Purwadi.

In the chorus of the song "Greet", Hetty Koes Endang changed the phrase "my life and death" in the lyrics to "my love". This is considered to have violated the copyright held by Richard Kyoto.

"He changed the lyrics, he said because at that time the lyrics of the song were not accepted by the Malaysian people. Because 'life and death for you' were only for Allah. I said this is a song language, he changed it, meaning it was different," said Richard Kyoto.

At the third point, the legal team said that the performance was documented, duplicated, and circulated without the permission of the songwriter.

Furthermore, the legal team said that the violation of economic rights was exacerbated by a violation of moral rights. Richard Kyoto's name was not listed as a songwriter.

"On the cover of the song, the song 'Love' is written by the name of the creator of another person, not Richard Kyoto, but this is mentioned by Muh Nasir bin Muhammed. This is suspected to be Malaysian citizenship," concluded Purwadi.
