BPN Intervenes In The Land Dispute Of Rocky Gerung-Sentul City

JAKARTA - The Ministry of Agrarian and Spatial Planning/National Land Agency (ATR/BPN) will check the coordinates of the disputed land between political observer Rocky Gerung and PT Sentul City Tbk (BKSL).

"For these two cases, the Ministry of ATR/BPN, both Central and the Land Office, will first see where the coordinates are, whether the coordinates overlap on the land claimed by both parties or not," said the Special Staff of the Minister of ATR/Head of BPN for Institutional Affairs. as well as Spokesperson for the Ministry of ATR/BPN Teuku Taufiqulhadi in a written statement received in Jakarta, reported by Antara, Monday, September 13.

Taufiqulhadi said that later the Ministry of ATR/BPN would check all Building Use Rights (HGB) documents, both physical data and juridical data, as well as documents owned by all communities in the disputed area.

He revealed that there are two things that need to be considered in the rules of the game regarding land ownership. First, pocketing proof of ownership in the form of a letter or land certificate. Second, physical mastery. If in this case, PT Sentul City Tbk claims to be the holder of the HGB certificate, then the company must ask the court to vacate the disputed land first.

"Later on, the court will execute and the execution cannot be carried out unilaterally or by force by directing the Satpol PP or thugs," he said.

Taufiqulhadi also advised the public to avoid land dispute cases when buying land more carefully, whether the land is in dispute or not, so that in the future there will be no unwanted legal problems.

"In some areas, there are indeed many disputes involving the land mafia and suddenly the land has changed hands to other parties, so people here have to be more selective in buying land," he said.

For information, a dispute over ownership claims occurred between one resident, namely Rocky Gerung, and PT Sentul City Tbk on land located in Bojong Koneng, Babakan Madang, Bogor Regency, West Java.

PT Sentul City Tbk claims to be the rightful holder of the certified land parcel currently occupied by Rocky Gerung. Meanwhile, Rocky denied taking the land of Sentul City because he had bought land and buildings at that location legally and recorded by state institutions 12 years ago, or in 2009.
