Ministry Of Manpower Finds 364 Foreigners Working Without RPTKA In West Kalimantan

The Manpower Supervisor of the Ministry of Manpower (Kemnaker) conducted a surprise inspection (sidak) regarding the application of the norm of using foreign workers (TKA) in the Ketapang Industrial Estate, Pagar Mentimun District, Ketapang Regency, West Kalimantan, on Tuesday 11 November 2025.

During the inspection, the supervisor found 364 foreign nationals (WNA) who worked without the ratification of the Foreign Workers Use Plan (RPTKA) document.

This finding came from two different companies, namely PT SZCI as many as 202 people and PT BAP as many as 162 people.

The Director-General of Manpower and K3 Supervision, Ismail Pakaya, explained that the inspection was carried out in response to a work accident that killed a foreigner, Wang Abao, who is known to have no RPTKA documents.

"To ensure compliance between the two companies with labor regulations, it will continue until November 14, 2025," said Ismail Pakaya in his statement through a press release from the Public Relations Bureau of the Ministry of Manpower, Thursday, November 27.

However, he continued, the implementation of the inspection had encountered obstacles. One of those claiming to be the area manager rejected instructions to issue foreigners within 3\times24 hours. The instruction was issued taking into account the geographical conditions and mobility capabilities of the company.

"In order for the situation to remain conducive, the supervisor chose to resign after obtaining a statement from the relevant parties that would bear the consequences of the rejection," said Ismail.

Separately, the Director of Labor Norm Examination, Rinaldi Umar, emphasized that all forms of barriers to supervisory duties were successfully overcome. He ensured that the process of removing foreigners was carried out according to the regulatory stages.

"Providing maximum service to tenants is important, but do not let them deal with the labor inspector who is carrying out the task of enforcing the rules," he said.

Rinaldi added that the Ministry of Manpower continued to act professionally and proportionally in responding to the incident.

His party will impose administrative sanctions on the two companies that violate the provisions for using foreign workers as regulated in the Minister of Manpower Regulation Number 8 of 2021.

Dia mengingatkan bahwa kewajiban memiliki RPTKA tercantum jelas dalam Pasal 42 Ayat (1) Undang-Undang Nomor 6 Tahun 2023, yang menyatakan bahwa setiap pemberi kerja TKA wajib memiliki RPTKA yang disahkan pemerintah pusat.

“Pengecualian hanya dapat diberikan dalam keadaan tertentu sesuai ketentuan perundang-undangan,” tegas Rinaldi.

He reminded that the obligation to have RPTKA is clearly stated in Article 42 Paragraph (1) of Law Number 6 of 2023, which states that every TKA employer must have RPTKA which is ratified by the central government.

"Exclusion can only be given under certain circumstances in accordance with statutory provisions," said Rinaldi.
