Deputy Chairman of Commission VI DPR RI Nurdin Halid said PT Pupuk Indonesia (Persero) and PT Pupuk Kalimantan Timur (Pupuk Kaltim) had no legal obligations in the polemic of resolving the demands of retired companies due to the restructuring of Jiwasraya.

For your information, a number of retired Pupuk Kaltim policies which were originally borne by PT Asuransi Jiwasraya or Jiwasraya have been transferred to PT Asuransi Jiwa IFG or IFG Life in line with the restructuring of Jiwasraya.

This polemic originated from a number of retired PKT asking for the benefits of retiring to be paid for life, in accordance with the provisions before the restructuring.

However, when the restructuring has been agreed that there will be a change in the time limit or not valid for life.

"Actually, Pupuk Kaltim and Pupuk Indonesia have no legal relationship in this case. The one with legal relations is Jiwasraya," he said during a hearing by Commission VI of the DPR with Pupuk Indonesia and Jiwasraya, Thursday, February 6.

"The status of Pupuk Kaltim here is to help overcome the problems of retirees (companies)," he continued.

Nurdin assessed that there had been an effort to Pupuk Kaltim to help the process.

However, he continued, currently there is no legal basis to strengthen the company's decisions.

"Now, Pupuk Kaltim to help (provide assistance) must have a legal basis. Now the legal basis does not yet exist," said Nurdin.

According to Nurdin, Pupuk Indonesia has shown good faith by asking for legal opinion from the Deputy Attorney General for Civil and State Administration (Jamdatun) to ensure that there is a legal basis for strengthening the company's decisions.

"So, the point is to help, not the obligation (Pupuk Kaltim). So that's what we need to understand, that Pupuk Kaltim is not an obligation from a legal perspective, it is Jiwasraya who has an obligation. If the Pupuk Kaltim is finished," he said.

Similarly, Member of Commission VI of the Indonesian House of Representatives from the National Awakening Party faction, M. Nasim Khan, emphasized that legal compliance must be the basis for resolving this problem.

"But also here there must be a legal opinion that must be understood by retirees at PKT (Pupuk Kaltim)," said Nasim.

According to Nasim, the Jiwasraya insurance policy problem has been resolved and retired Pupuk Kaltim has also chosen one of the policy restructuring scheme options offered.

However, there needs to be a premium top up with an accumulation value of IDR 488.2 billion for policies with an escalation of 2 percent per year and IDR 135 billion for policies without escalation.

The second option is the amount of postacity benefits borne by Jiwasraya from retired Pupuk Kaltim, although the term of payment of benefits remains for life. The decline occurred at 40 percent for policies with an escalation of 2 percent per tagun and 39.4 percent for policies without escalation.

The third option, the term of postacity for retirees is shorter. But the amount of benefits provided remains in accordance with the initial value.

In this section, the average distribution of benefits applies to 13-14 years for retirees.

Previously, it was reported that PT Asuransi Jiwa IFG (IFG Life) revealed that it had paid Rp. 284.41 billion for the benefits of retired PT Pupuk Kalimantan Timur (Pupuk Kaltim) since the transfer of dependents in the context of restructuring PT Asuransi Jiwasraya from 2022 to the end of 2024.

The President Director of IFG Life, Budi Tampubolon, explained that the payment process for benefits to retired East Kalimantan Pupun has been carried out since IFG Life received a transition from Jiwasraya on January 28, 2022 and March 3, 2022.

"From 2022 to the end of 2024 we have paid specifically for this retired Pupuk Kaltim as much as Rp284.41 billion," Budi said in a meeting with Commission VI DPR RI, Jakarta, Thursday, February 6.
