"We have already tried (previously), but the defendant and the defendant did not come. The trial was postponed for 2 weeks," said PT GSP attorney Dr Amir Syamsudin SH, MH, in Jakarta, Tuesday, October 29.

Amir explained that the lawsuit, especially regarding the unilateral termination of the Bangun Guna Serah Cooperation Agreement (Build, Operate, Transfer/BOT) which was signed by both parties on October 22, 1991.

Amir added that according to Article 8 paragraph 2 of the Agreement mentioned, when the Agreement ended on October 21, 2024, PT GSP had the first option to extend the Agreement with PPKGBK based on the requirements to be determined later.

However, the article was ignored and rejected by PPKGBK which plans to manage the Convention Hall Building independently.

"We take this legal step to protect business interests and legal certainty over the rights of PT GSP listed in the BOT Cooperation Agreement which was signed on October 22, 1991. We deeply regret the efforts of PPKGBK to deny the agreement that has become a mutual agreement," said Amir.

Amir explained that PT GSP had implemented and carried out all the obligations stated in the agreement.

Among them are building supporting infrastructure and other facilities, both commercial and non-commercial in the Senayan Sports Center, which is now known as the Jakarta Convention Center Convention Center.

As the manager of JCC, PT GSP has also succeeded and has become a pioneer in the growth of the Meeting, Incentive, Convention, Exhibition (MICE) industry in Indonesia.

JCC is the first MICE building with international standards and successfully runs state events, and various other business actors. As the manager of the JCC, PT GSP has also carried out all its obligations to the state in accordance with applicable regulations.

"The PPKGBK action to ignore the agreement that has been agreed will set a bad precedent for all business actors in collaboration with the Government Public Service Agency (BLU) in the GBK area," explained Amir.

Amir further added that PT GSP had actually submitted a request for an extension of the Agreement in accordance with applicable regulations.

In addition to referring to Article 8 paragraph (2) of the Agreement, PT GSP also based its application on the Minister of Finance Regulation No. 202 / PMK.05 / 2022 which regulates guidelines for managing the Public Service Agency (BLU), including extending cooperation with private partners. However, the request for an extension was rejected by PPKGBK.

The rejection of the PPKGBK is based on the Minister of Finance Regulation No. 129/PMK.05/2020, which states that the management of land and building assets is only valid once and cannot be extended. PT GSP considers that this rejection is not in accordance with the provisions stipulated in the BOT Agreement and relevant regulations.

"PPKGBK uses the base of irrelevant rules to reject our petition, even though we have the legitimate right to extend management in accordance with the original agreement," added Amir.

During the legal process, PT GSP is committed to maintaining the sustainability of JCC operations as the leading MICE center in Indonesia. To partners, vendors and parties who have contracted, PT GSP ensures that scheduled events will continue and get service standards from the JCC.

"We will continue to follow applicable legal procedures and cooperate with related parties to resolve this problem properly and fairly. We are also open to resolving the issue of violating the Agreement by the PPKGBK in accordance with applicable regulations," concluded Amir.
