JAKARTA - The Ministry of Law (Kemenkum) reminds that every playing of a song for commercial purposes in public spaces must respect the economic rights of the creator through the payment of royalties in accordance with the provisions of laws and regulations.
The Director of Copyright and Industrial Design of the Directorate General of Intellectual Property (DJKI) of the Ministry of Law and Human Rights, Damarsasongko, emphasized that the use of religious songs in commercial areas has legal consequences.
"We appeal to business actors, ranging from shopping centers, hotels to digital platforms to ensure that religious songs are played with respect for the economic rights of creators. This is a form of appreciation for musicians who have worked," said Agung in a statement confirmed in Jakarta, Tuesday.
Entering the holy month of Ramadan, he said, religious songs again echoed in various shopping centers, hotels, restaurants, and cafes as an accompaniment to community activities.
Agung admitted that the annual phenomenon also contributed to the growth of religious music in Indonesia. Works from musicians such as Opick, Bimbo, to Maher Zain are often the choice to build a shady atmosphere before breaking the fast.
According to him, the presence of religious music has become an integral part of the Ramadan tradition in commercial spaces.
He explained that based on Law Number 28 of 2014 concerning Copyright and Government Regulation Number 56 of 2021 concerning the Management of Copyright Royalty for Songs and/or Music, any commercial use of a song in a public service is categorized as a public performance that requires payment of royalties through the National Collective Management Agency (LMKN).
"This system is designed to make it easier for business actors because it uses a one-pint scheme so that music users do not have to contact each creator separately," he said.
To fulfill this obligation, he explained that business actors can access the official LMKN website and choose the license category according to their business type.
Furthermore, business actors can fill out a license application form by completing business data and plans for using music.
After the verification process, he continued, LMKN will issue a proforma invoice alias proforma invoice as the basis for royalty payments.
After the payment was made, Agung said business actors would receive a license certificate as proof of the legal use of songs commercially.
He asked business actors to compile and store a list of songs (log sheet) that are played to support the distribution of royalties that are accurate, transparent, and targeted to the right creators.
DJKI invites all business actors to use the momentum of Ramadan as an opportunity to strengthen legal awareness in the field of intellectual property.
By respecting and fulfilling royalty obligations correctly, he said, business actors also maintain the sustainability of the national music industry and ensure that creators continue to receive fair rewards for works that enliven the holy month.
