Why People Must Know What It Is To Hold Cases And Their Impact On Legal Cases

YOGYAKARTA - The basic question of what it is is is that case titles are important for those of you involved in the legal process. This process is the key to understanding the flow of case handling by law enforcement.

The definition of the case title is formally regulated in the Regulation of the Head of the Criminal Investigation Agency of the Indonesian National Police Number 4 of 2014. Article 1 paragraph (17) defines it as:

The activity of delivering explanations about the process or results of investigations and investigations by investigators to title participants in the form of group discussions to get response/input/correction in order to produce recommendations to determine follow-up to the investigation process.

The function of the case title is a mandatory step for law enforcement officials before making a decision.

This process is carried out to ascertain whether someone should be suspected of being a suspect based on the material evidence that has been collected and examined.

Well, through this function, investigators are assisted to provide an objective and clear picture of the legal status and aspects of a problem, especially in cases that are considered unclear.

As explained above, the function of Holding a Case in investigating a criminal act is a vital effort. This process helps investigators to find a bright spot in the disclosure of cases being handled.

The results of the case title also determine several things: whether the investigation will be continued, terminated, or the most crucial, whether to designate someone as a suspect in a criminal act.

The existence of a case title, thus aims to ensure that investigators are not wrong in making legal decisions with a big impact.

At first, the investigative team initially received a public complaint (Dumas) regarding the alleged violation of the law. After the initial investigation (investigator) is carried out, the investigative team needs to determine whether the criminal element really exists or not, here are the steps:

This case involves documents that need to be verified for authenticity and involve public figures, so that they have high complexity and sensitivity. To ensure the objective and accountable running process, it was decided to hold a Special Case (GPK).

The title of Special Cases is carried out by inviting internal participants (Directorate of Criminal Acts, Internal Supervisors) and external (for example, representatives of Kompolnas, Komnas HAM, or even independent experts such as telematics experts).

All the evidence collected (the results of the investigation, the results of the forensic examination of documents, witness statements, and others.) were examined and discussed in depth by all participants.

If the results are reinforcing, then the case title will result in recommendations to raise the status of the case from investigation to investigation, and the potential for determining the suspect if the initial evidence is deemed sufficient.

However, if it weakens, in the case of this alleged fake diploma, the title of the case may conclude that there is no element of a criminal act that can be proven, so that the investigation is stopped (SP3).

Simply put, the title of the case becomes an official forum for investigators to explain their findings in front of supervisors, and the decision to continue or stop the case (or determine a suspect).
