Case Of Shooting Between Police Brothers, South Sulawesi Prosecutor's Office Agrees To Restorative Justice

Head of the South Sulawesi High Prosecutor's Office (Kejati) Agus Salim approved a restorative justice (RJ) application or restorative justice from the Makassar District Attorney for the shooting incident between police officers who were still brothers.

"We have seen that the testimonies of victims, suspects and community leaders have complied with the provisions of the Prosecutor's Regulation Number 15 of 2020 regulates the Termination of Prosecution Based on Restorative Justice. The victim has forgiven the suspect," said Agus Salim while exposing a request for RJ for virtual shooting at the South Sulawesi Prosecutor's Office, Makassar, Tuesday, July 15, reported by ANTARA.

Agus stated that on behalf of the leadership, his party approved the RJ application submitted, and he asked the Makassar District Attorney to immediately complete all case administrations and the suspect was immediately released.

"I hope that the settlement of this case will be zero transactional to maintain the trust of the leadership and the public," said Agus Salim who was accompanied by the Assistant for General Crimes (Aspidum) of the South Sulawesi Attorney General's Office Rizal Syah Nyaman, Coordinator Nurul Hidayat, and Head of Sections of People and Property (Kasi Oharda) Alham.

The expose of the RJ case was followed virtually from the Makassar Kejari attended by the Head of the Makassar Kejari, Nauli Rahim Siregar, accompanied by the Head of the General Crime Section (Kasi Pidum), the Facilitator Prosecutor, and the Makassar Kejari.

The case that was exposed was the shooting case with suspect Suardi (43) who was suspected of violating Article 360 paragraph (1) of the Criminal Code.

The suspect is an active member of the National Police, and the shooting victim is Wahyuddin (44), the older brother of the suspect Suardi who is also an active member of the National Police.

The shooting incident between police officers who were still brothers occurred on Saturday, May 3, 2025 at around 23.00 WITA at the T-junction of Jalan Jalahong Daeng Matutu, Bara-Barrayya Village, Makassar District, Makassar City.

At that time, suspect Suardi was asked by his brother Wahyuddin to help catch a fugitive in a motorcycle theft case called Aldi Monkey. However, when he was arrested, only two of them fought back and there was a wrestling battle.

When the suspect Suardi tried to help his brother Wayhuddib by shooting the perpetrator, the bullet disappeared and hit Wahyuddin in the right chest. Meanwhile, the perpetrator AldiMonye immediately fled.

The victim was immediately rushed to Bayangkara Hospital, and fortunately the victim's life was saved after being treated for three days in hospital.

Based on the Makassar City Attorney's Office's proposal for the case, there are several considerations, namely the suspect Suardi has committed a criminal act for the first time and is the backbone of the family.

Meanwhile, the victim Wahyudin has also recovered from his wounds and has returned to normal activities. The victim has also submitted a request for RJ and a peace agreement has been reached between the two parties.

The suspect and the victim are siblings, and the public responded positively to the settlement of this case through RJ, and the suspect was also not a recidivist.

Regarding the proposal, Kajati Sulsel Agus Salim approved the RJ application after considering the terms and conditions stipulated in the Indonesian Prosecutor's Regulation Number 15 of 2020 concerning Restorative Justice

Agus Salim said the exposure to the RJ case shows the commitment of the South Sulawesi Prosecutor's Office in applying the principles of restorative justice, which prioritizes restoring relations between victims and suspects and resolving cases outside of court channels.
