The Verdict Of The Former Acting Kadinsos HST Central Kalimantan Is Lighter Than The Demand, The Public Prosecutor Files An Appeal

The public prosecutor (JPU) in the corruption case of the activities of the Social Service (Dinsos) of Hulu Sungai Tengah Regency (HST) in Central Kalimantan (Kalteng) for the 2022 fiscal year appealed the decision against the defendant Wahyudi Rahmad.

The former Acting (Plt) Head of the HST Social Service (Kadinsos) was sentenced to a year in prison.

"We are filing an appeal because the decision of the panel of judges is under the demand and does not fulfill a sense of justice," said Head of the Special Crimes Section of the HST Kejari, Hendrik Fayol in Barabai, HST, Central Kalimantan, Friday, March 14, as reported by Antara.

The prosecutor previously demanded 1 year and 6 months in prison for the defendant Wahyudi Rahmad. However, the verdict handed down by the panel of judges at the Banjarmasin Corruption Court (Tipikor) was lighter, namely one year in prison.

Then, the judge also imposed a fine on the defendant of Rp. 50 million or a subsidiary of imprisonment for one month lighter than the prosecutor's demands with a fine of Rp. 100 million or a subsidiary of six months in prison.

In this case, the defendant was found guilty of joint corruption in the indictment of the subsidiary of the Public Prosecutor Article 3 of Law Number 20 of 2001 concerning the Eradication of Corruption in conjunction with Article 55 paragraph 1 of the Criminal Code.

However, the defendant was acquitted of the primary indictment of Article 2 in conjunction with Article 18 of Law Number 30 of 1999 which was amended by Law Number 20 of 2001 concerning the Eradication of criminal acts of corruption in conjunction with Article 55 paragraph 1 of the Criminal Code.

"We are waiting for the verdict at the appeal level, maybe in the next two or three months the verdict will come out, hopefully it will fulfill the sense of justice," he said.

In this case, the defendant Wahyudi Rahmad resulted in state financial losses of around Rp. 389 million due to the defendant's actions with MS (separate files).
