KY Can't Fulfill Supreme Court's Request To Open Selection Of Candidates For Supreme Court Justices 2025

JAKARTA - A member of the Judicial Commission, Taufiq HZ, said that his institution could not fulfill the Supreme Court's request to carry out the selection of candidates for Supreme Court justices and ad hoc judges for human rights by 2025 due to budget efficiency.

"In the steps to carry out the selection tasks of candidates for Supreme Court justices and ad hoc at the Supreme Court, the Judicial Commission upholds the integrity of the selection process and the quality of the selection results. However, in connection with budget efficiency that affects the implementation of tasks, the Judicial Commission cannot carry out the selection of Supreme Court justices and ad hoc HAM judges to the Supreme Court to meet the Supreme Court's request," said Taufiq at the KY Policy Press Conference regarding the Efficiency of the Implementation Budget for Candidates for Supreme Court Justices which was monitored online from Jakarta, Antara, Friday, February 7.

This was conveyed by Taufiq to answer the Letter of Deputy Chief Justice of the Supreme Court of the Republic of Indonesia for non-Judicial Affairs Number 5/WKMA.NY/KP1.1.1/I/2025 dated January 15, 2025 regarding filling the vacancy of the position of Supreme Court at the Indonesian Supreme Court and the letter of Deputy Chief Justice of the Supreme Court of the Republic of Indonesia for Non-Judicial Affairs Number 6/WKMA.NY/KP1.1.3/I/2025 dated January 15, 2025 regarding filling the vacancy of ad hoc HAM judges at the Indonesian Supreme Court.

"According to the law, KY must carry out announcements on 15 working days from the receipt of the letter on January 16, 2025," he said.

In the letter, the Supreme Court conveyed the vacancy of 16 Supreme Court justices consisting of five criminal chamber Supreme Court justices, two civil chamber Supreme Court justices, two religious room Supreme Court justices, one military chamber chief judge, one PTUN chamber attorney, five attorneys. room for special tax Ad hoc HAM, and three judges.

Meanwhile, KY spokesman Mukti Fajar Nur Dewata explained that KY refers to Presidential Instruction (Inpres) Number 1 of 2025 concerning Expenditure Efficiency in the Implementation of the State Revenue and Expenditure Budget (APBN) and the 2025 Regional Revenue and Expenditure Budget (APBD) which was followed up with a letter from the Minister of Finance Number S-37/MK.02/2025 concerning Expenditure Efficiency for Ministries/Agencies in the implementation of the 2025 State Budget.

"Therefore, KY is also one of the institutions that must carry out budget efficiency," explained Mukti.

He said KY made 54.35 percent efficiency from the 2025 budget ceiling. This has an impact on the selection of candidates for Supreme Court justices and candidates for ad hoc judges at the Supreme Court which is also the object of budget efficiency.

"The KY budget which was cut was around 54.35 percent. Even after being observed, it was not enough for office daily operations," he added.

Therefore, with the efficiency of the budget, KY cannot work and carry out a number of tasks, including carrying out the selection of candidates for Supreme Court justices and candidates for ad hoc judges at the Supreme Court.

The Ministry of Finance has implemented an efficiency measure for the K/L budget of IDR 256.1 trillion for the 2025 fiscal year.

This is in accordance with Presidential Instruction Number 1 of 2025 which was confirmed through the Letter of the Minister of Finance Number S-37/MK.02/2025.

In this case, Finance Minister Sri Mulyani Indrawati instructed the minister/leader of the institution to identify the K/L spending efficiency plan.

This efficiency includes operational and non-operational spending in all ministries/agencies. Even so, the Minister of Finance explained that the savings plan will not touch employee spending or social assistance.
