JAKARTA - The lawsuit between the Candidates for Governor and Deputy Governor of North Sulawesi serial number 2 Elly Engelbert Lasut and Hanny Joost Pajouw regarding the results of the 2024 Pilkada at the Constitutional Court has been officially granted to be revoked.
"Stipulate, grant the withdrawal of the petitioner's petition Number 261/PHPU.GUB-XXIII/2025. State that the applications in the cases above are withdrawn," said Chairman of the Constitutional Court (MK) Suhartoyo at the trial for the pronunciation of decisions/decisions at the Constitutional Court Building, Jakarta, Antara, Tuesday, February 4.
Based on the judge's deliberation meeting (RPH) on January 30, 2025, the withdrawal of Elly Lasut-Hanny Pajouw's application was concluded to be legally reasonable. Thus, the revocation of the request was granted and both of them could no longer file the case in question.
"To declare that the applicant cannot re-submit the a quo application," said Suhartoyo.
Previously, Elly Lasut-Hanny Pajouw's attorney, Denny Indrayana, at the inaugural hearing on January 13, 2025, stated that his client had withdrawn the lawsuit so that the case would not be rolled out in the Court.
"We, the attorney from the candidate for governor of case 261, have submitted a letter on December 13, 2024 with a receipt of an entry letter in the ministry, which in essence in the letter states that we have submitted a withdrawal of this case application," said Denny.
Based on the application file, Elly Lasut-Hanny Pajouw initially asked the Constitutional Court to disqualify candidate pair number 1 Yulius Selvanus and Johannes Victor Mailangkay, as well as cancel the North Sulawesi KPU decision as long as Yulius-Johannes vote acquisition.
The North Sulawesi KPU previously named Yulius-Johannes as the pair of candidates who won the most votes, namely 539,039 votes.
Meanwhile, Elly Lasut-Hanny Pajouw received 463,433 votes and candidate pair number 3 Steven Kandouw and Alfret Tuejeh received 459,673 votes.
However, Elly Lasut-Hanny Pajouw argued that Yulius-Johannes' votes were obtained in ways that violated election principles.
Yulius was named a former convict in the 1998 activist kidnapping case, but did not publicly announce his legal status.
In fact, according to Elly Lasut-Hanny Pajouw, Article 11 of KPU Regulation Number 8 of 2024 stipulates that former convicts who run for regional heads are obliged to notify the public of their status as former convicts.
