JAKARTA - The Directorate General of Intellectual Property (DJKI) of the Ministry of Law responded to the latest song by the Radja music group entitled "What Sih" which has recently been widely discussed on social media for allegedly plagiarizing the song APT belonging to international singers Bruno Mars and Rose BLACKPINK.

Director of Copyright and Industrial Design of DJKI Agung Damarsasongko said that any commercial use of copyrighted works without permission from the creator or copyright holder has serious legal consequences.

"Creature rights are the exclusive rights of creators or copyright holders of their works. Violations of these rights can not only harm creators, but also disrupt the creative industry ecosystem," Agung said in a statement quoted by ANTARA, Friday, January 3.

In essence, the violation of song copyright occurs when the use of other party's copyright without rights, either entirely, partially, or substantially. However, it is necessary to first review the location of the similarities between the two songs that are thought to be similar.

"Creating a work and expressing is everyone's right, but caution is needed so as not to harm other parties," added Agung.

Creators and copyright holders can make summons to prohibit others from composing or using their songs without permission. If the subpoena is violated, the creator and copyright holder can report to the investigator of the National Police or the investigator of the DJKI Civil Servant.

If proven to be detrimental to the creator or copyright holder, those who commit violations can be punished according to the provisions of Law Number 28 of 2014 concerning Copyright.

In addition, DJKI invites digital platforms that commercialize copyright to have their respective policies in order to protect the rights of each creator.

Agung also reminded that respect for copyright is an important foundation in the creative industry. He appealed to industry players to always create original works and respect the copyright of others.

In addition to inviting the public to care about copyright protection, DJKI also encourages all creators to record their creations through the e-HakCipta electronic system. This is a step to prevent copyright infringement in the future.

"By recording their work, creators will get strong legal protection, so that they can protect their creativity from irresponsible actions," said Agung.
