The Prosecutor Says He Has Not Received Appeal Decision Files Of Pinangki Sirna Malasari

JAKARTA - The Public Prosecutor (JPU) at the Central Jakarta District Prosecutor's Office has yet to take steps on the decision of the DKI Jakarta High Court which reduces the sentence for Pinangki Sirna Malasari.

In that decision, Pinangki Sirna Malasari's sentence was reduced to 6 years, which was originally 10 years in prison.

"We have not received the PT (High Court) decision", said Head of the Central Jakarta District Attorney (Kajari) Riono Budi Santoso in his statement, Tuesday, June 15.

Later, after receiving the decision file from the DKI Jakarta High Court, Budi continued, his party will study in depth first.

Then he determines the next step. The prosecutor still has the authority to file legal remedies against the appeal decision through a Supreme Court (MA) appeal.

"The prosecutor will study it first, especially the considerations so that we can determine the next position", said Budi.

Previously, it was reported that the DKI Jakarta High Court (PT) cut the sentence of Pinangki Sirna Malasari from 10 years to four years in prison in cases of accepting bribes, conspiracy, and money laundering.

The decision was taken by the chairman of the panel of judges, Muhammad Yusuf, with member judges Haryono Singgih Budi Prakoso, Lafat Akbar, and Renny Halida Ilham Malik on June 14, 2021.

There were a number of considerations by the panel of judges that reduced Pinangki's sentence by more than half:

"That the defendant pleaded guilty and said he regretted her actions and had agreed to be dismissed from her profession as a prosecutor. Therefore, she can still be expected to behave as a good citizen. That the defendant is a mother of a child who is still a toddler (aged four years) deserves the opportunity to care for and give love to her child in growth period", said the judge.

Another consideration is Pinangki as a woman should receive attention, protection, and be treated fairly.

"Whereas the Defendant's actions cannot be separated from the involvement of other parties who are also responsible so that the level of guilt affects this decision. That the criminal charges of the Prosecutor/Public Prosecutor as the holder of the Dominus Litus principle who represents the state and government are considered to have reflected the community's sense of justice", added the judge.
