JAKARTA - Legal expert, Yenti Garnasih, questioned the purpose and urgency of the National Human Rights Commission (Komnas HAM) to summon the head of the Corruption Eradication Commission (KPK), Firli Bahuri.
"I also don't know, why is that? What does Komnas HAM have to do with what someone or another institution does that violates human rights? So, what is this? Yenti Garnasih said via electronic message reported by Antara, Thursday, June 10.
The plan to summon Firli Bahuri is related to the National Insight Test (TWK) which KPK employees complained to Komnas HAM. Yenti added that TWK is a product of the State Civil Service Agency (BKN), certainly has a team in formulating the test questions.
"In my opinion, what is the urgency of calling, especially since Mr. Firli is at work, why are you being called back and forth", said Yenti.
She considered it right that Firli did not comply with the Komnas HAM call. According to her, Komnas HAM should have called in case of human rights violations.
"It's true, you don't have to come. Mr. Firli violates human rights, what do you want to ask Mr. Firli, it should be related. For example, in the policy, there is a violation of human rights. Mr. Firli did not issue any policy", Yenti said.

According to her, the policy issued by the KPK leadership is a mandate from Law Number 19 of 2019 concerning the KPK.
If TWK is deemed to have violated human rights, Komnas HAM should summon the legislators, even if there is content that is deemed to violate human rights.
Thus, he considered that it was inappropriate for Komnas HAM to summon Firli Bahuri if he questioned the law.
"If you want to make a fuss, it is not Firli who is called, the DPR and the government who at that time made the KPK Law. If it is related to what is being questioned in the tests, it is BKN called," he said.
He reminded BKN has standardization in the tests that are made. Of course, Komnas HAM could not immediately suspect that there was a violation in the TWK.
"The examiner has a certification, he can't be interrupted like that. Komnas HAM will try to see for yourself, regarding what Firli was summoned for, what human rights violations Firli committed", she said.
Yenti is worried that everything will be politicized. According to her, the political space is in the House of Representatives, when the law was made and the political nuances should have ended.
When the law is implemented, according to her, there will be no political touch. She suggested that Komnas HAM, an organization that has been known to be independent, should be able to get away from political nuances.
"Yes, if they are independent, they shouldn't be allowed to the presumption that they are in politics. Don't make it even noisier", said Yenti.
