The National Police Respects The Constitutional Court's Decision On Prohibition Of Active Members From Occupying Positions Outside The Police Structure

JAKARTA - The National Police of the Republic of Infonesia (Polri) through the Head of the Public Relations Division of the National Police, Inspector General Sandi Nugroho, said that his party respects the decision of the Constitutional Court (MK) which states that active members of the National Police cannot occupy positions outside the police structure. The decision requires members of the National Police who are currently serving in other institutions to resign or retire from the police service.

Inspector General Sandi Nugroho also said that his party was still waiting for an official copy of the Constitutional Court's decision to be studied further.

"Incidentally, we have just heard the decision. Of course, the National Police will respect all the decisions that have been issued, and at this time the Police are still waiting for the official results. Later it will be reported to the National Police Chief, and then the results of the decisions that have been decided today," he told reporters, at the STIK-PTIK Building, South Jakarta, Thursday, November 13, 2025.

Sandi emphasized that even though he had not received an official copy, the National Police would pay attention and carry out the court's decision after it was thoroughly studied.

"If it has been decided and we have learned what has been decided, the Police will always respect the court's decision that has been decided," he said.

Regarding internal regulations, Sandi explained that the mechanism for assigning members of the National Police outside the institution has actually been regulated in the internal police regulations.

"For the rules, of course, it is within the internal police and has met the specified criteria, be it based on requests from institutions that require the presence of the Police and are equipped with permission from the Chief of Police," he explained.

The National Police, continued Sandi, will adjust to the new provisions contained in the Constitutional Court's decision.

"We have heard and saw today's decision. We are just waiting to see what the concrete verdict looks like, so that we can see, study, and determine what the police should do," he concluded.

The Constitutional Court (MK) has decided that members of the National Police who occupy positions outside the police or civil office must resign, or retire from the police service.

In Decision Number 114/PUU-XXIII/2025, the Constitutional Court also removed the provisions that had been an opening for active police officers to occupy civilian positions without having to release their membership status first.
