The DPR Baleg Regarding The Asset Confiscation Bill: Draft From The Government Is Not Right, Collision With The Law

JAKARTA - Deputy Chairman of the Legislation Body (Baleg) of the DPR, Sturman Panjaitan, responded to the issue of public pressure so that the DPR immediately ratified the Asset Confiscation Bill. Sturman said the discussion of the bill stalled because the draft proposed by the government still needed adjustments.

"As long as that was the government's proposal, yesterday the draft was said to be not right, colliding (with the existing law), so if we discuss it, the story will be long," said Sturman at the Parliament Complex, Senayan, Jakarta, Thursday, September 4.

"The concept, which according to the person, is not right, is because it intersects with others," he continued.

Even if it is changed to a proposal from the DPR, according to Sturman, the Asset Confiscation Bill will take a long time. This is because the DPR must make a study by listening to public input first.

"Yes, if it becomes a proposal from the DPR, the DPR must first make the draft, we must first RDPU, public hearings, experts, legal experts, economists, any experts," said the member of Commission III of the DPR.

"But until now in the 2024-2029 Prolegnas it is still the government's proposal, but that's okay, whoever proposes it's okay. The important thing is not to conflict, to collide with the existing law, that's all," he continued.

Sturman revealed that the leadership of the Legislative Council (DPR) for the past period said that the draft Bill on Confiscation of Assets proposed by the government still needed a lot of improvement. So that the Legislative Council (DPR) for the current period is still waiting for the government to send a new draft.

"The old concept, we also haven't found it in the Legislative Body, but according to the Baleg chairman, it is not right because it collided with the existing law. For example, if there are no suspects, they have just been questioned, suspected, their assets will be confiscated immediately," he said.

"(The new draft) is the authority of the government, as long as it is the government's proposal, the government has the authority, if Baleg's proposal I will tell the story," added the PDIP politician.

Nevertheless, Sturman opens the possibility that the Asset Confiscation Bill has the opportunity to be used as the omnibus law, because it coincides with the Corruption Act and TPPU.

"Nothing is impossible in the world, everything is possible. (But the omnibus) It must be studied, there are experts, this father, legal expert, quarantine," he said.

Sturman juga membuka kemungkinan RUU Perampasan Asset untuk di take over menjadi usulan inisiatif DPR. Namun perlu waktu untuk membahas, menyatakan, dan membuat draft usulan.

"Nothing is impossible, it could be, but in the meantime the government is still proposing, later we Baleg will see again, 'Okay we ask for this dpr, okay come on'. But there must be a statement first, because it has been proposed (the government)," he concluded.
