The Decision Of The LPS DK Pansel Is Considered To Have Violated The Law And Potentially Disrupted The Independence Of LPS In The Future
JAKARTA - The selection process for candidates for Chair and members of the Board of Commissioners of the Deposit Insurance Corporation (DK LPS) has drawn public attention. This is because the process carried out by the Selection Committee (Pansel) led by the Minister of Finance, Sri Mulyani Indrawati, is considered legally flawed.
The violation of the law from the selection process in Pansel included the existence of a candidate who registered as a Member of the Board of Commissioners, namely Dwityapoetra Soeyasa Besar. He admitted to registering as a candidate for member, but by the Pansel he was included as a Candidate for Chairman of the LPS Board of Commissioners.
The Pansel was also considered a violation for passing two of the three candidates for the LPS Board of Commissioners who did not resign from their positions as executive officials at financial services companies, while participating in registration and selection.
Economic observer from the University of Muhammadiyah Yogyakarta (UMY), Achmad Ma'ruf, recently said that the decision of the Pansel who was legally flawed was very dangerous, because it was able to trap the President and violate the law.
"This plunges the President, if the results of the selection at the Palace continue to pass the problematic names to the DPR," said Ma'ruf.
He suspects that the names suspected of violating the law were deliberately passed, because the team in Pansel itself came from elements of the Ministry of Finance, OJK and BI as well as professionals affiliated with certain groups who tried to strangulate the financial sector.
"In the past there was the Barkeley mafia, now there is an alley of the State Accounting College (STAN) which is suspected of trying to control the financial sector," said Ma'ruf.
That's what Ma'ruf said that made it difficult for the Pansel to be independent, even though they also made the rules, but at the same time they violated the rules they made.
"So how can the state want to progress like the President's dream if we can't pass on positive things to the younger generation," said Ma'ruf.
Therefore, he requested that the candidates who have passed the Selection Committee (Pansel) and will be submitted to the President immediately resign from the executive positions they are currently holding or resign from the selection.
Furthermore, he explained that the presence of prospective members who are still active in banking institutions and insurance has the potential to violate the provisions in Law Number 24 of 2004 concerning LPS, especially the provisions that are not changed in the P2SK Law.
"In carrying out its duties, the LPS DK election process must be subject to the LPS Law which is still in effect, must not violate existing regulations," said Ma'ruf.
He referred to Article 66 paragraph (2) of Law 24/2004 which states that members of the LPS Board of Commissioners must serve in full time and are not allowed to hold executive positions elsewhere, except in the context of official assignments or social activities.
In addition, Article 67 letter (i) confirms that candidates for DK LPS members cannot serve as consultants, employees, administrators, or bank owners and insurance companies, either directly or indirectly.
Based on the announcement of the LPS Pansel DK, two of the three names of prospective members who were declared to have graduated for the position of DK LPS Member for the Bank Guarantee and Resolution Program for the period 2025-2030 were still active in financial companies, namely Agresius R. Kadiaman (Risk Management and Compliance Director of PT Bank China Construction Bank Indonesia Tbk), and Ferdinan Dwikoraja Purba (Independent Commissioner of PT Asuransi Jasa Tania Tbk). Meanwhile, another candidate, namely and Teguh Supangang, currently serves as Deputy Commissioner for Financial Conglomeration Supervisory, OJK.
Meanwhile, the candidate who previously registered as a candidate for member and by the Pansel was proposed as a Candidate for Chairman of the Board of Commissioners, namely Dwityapoetra Soeyasa Besar, who is currently still the Executive Director of Surveillance, Examination, and Statistics of the LPS.
Before joining LPS, Dwityapoetra had a long career at Bank Indonesia. Meanwhile, another candidate is Muhammad Iman Nuril Hidayat Budi Pinuji, who is currently a member of the BPJS Employment Supervisory Board. Iman Nuril, who was a STAN graduate, also had a long career at LPS when the institution was still led by Fauzi Ichsan.
Finally, Purbaya Yudhi Sadive, who is currently still the Chair of the LPS Board of Commissioners. Purbaya, an economic technocrat who is an alumni of ITB's Electronic Engineering, won a Master of Science (MSc) and a Doctor's degree in Economic Science from Purdue University, Indiana, United States, already has a wealth of experience and reputation in the national economy.
Apart from having led Danareksa, he has also been a Deputy at KSP, the Coordinating Ministry for the Economy and the Coordinating Ministry for Maritime Affairs and Investment.
Ma'ruf also emphasized that in addition to candidates who must meet legal requirements, it is also important to maintain LPS independence, especially because elements of Bank Indonesia, the Financial Services Authority (OJK), and the Ministry of Finance already have representation through ex-officio customers in the LPS DK structure.
"Independence is absolutely necessary so that LPS does not have a conflict of interest with other institutions and remains a credible institution in maintaining the stability of the national financial system," he explained.
Ma'ruf also reminded the importance of considering track records, competence, and professionalism in the election of candidates for Chairperson and members of the LPS DK so that this institution can carry out its functions optimally.
"The figure sought for this position must not only be professional in the field of finance and investment, but must also have integrity and an independent attitude, not comply with interests outside the mandate of the institution," he said.

Ma'ruf reminded that many problems that befell public officials are rooted in an unnatural selection process, and even tend to be transactional. Therefore, he hopes that the election of the Chairperson and members of the LPS DK this time is truly clean and based on the mandate of the law.
"Hopefully the LPS leadership will continue to maintain this institution as it is today, namely as a credible and independent savings guarantor as mandated by law," he concluded.
On a separate occasion, Professor of Economic Science Monetary and Banking Universitas Airlangga (Unair), Surabaya, Wasiaturrahma, said that public service implementing officials are prohibited from holding concurrent positions as commissioners or administrators of business organizations. This is because of the potential for conflicts of interest, on the one hand, as a regulator who supervises, on the other hand, he is an industry actor.
Therefore, if certain candidates from industry players are interested in occupying positions in regulatory institutions (regulators), they should resign first. Moreover, there is already a law that regulates the mechanism.
He also agreed that if the selection process that violates the law continues, the results will be legally flawed and will have a bad impact on the performance of institutions and the economy in general. Moreover, if the selection process violates the law with the intention of placing figures that are ridden by covert interests.
