Boyamin Submits Material Test To The Constitutional Court To Sue The KPK Pansel Formation Jokowi

JAKARTA - Coordinator of the Indonesian Anti-Corruption Society (MAKI) Boyamin Saiman submitted a judicial review to the Constitutional Court regarding the validity of the selection committee of the Corruption Eradication Commission (KPK) formed by the 7th President of the Republic of Indonesia Joko Widodo (Jokowi).

"In my opinion, only the (pansel) formed by Mr. Prabowo Subianto," said Boyamin as quoted by ANTARA, Tuesday, November 5.

Boyamin referred to the Constitutional Court's decision with case number 112 / PUU-XX / 2022 which changed the term of office of the KPK leadership from four years to five years.

"That was in his consideration that the president could only once select the KPK leadership, and it was also written there that Pak Jokowi had conducted (selections) in 2019," he said.

Therefore, according to Boyamin, the KPK leadership for the 2024 '2029 period should be selected and/or submitted to the DPR and President for the 2024'-2025 period, in this case Prabowo Subianto.

Boyamin admitted that he had written to Jokowi. However, Jokowi still proposed a selection committee for the KPK leadership.

"Like it or not, I was forced to come to the Constitutional Court to determine who was authorized to form and hand over (the KPK panel) to the DPR," said Boyamin.

Boyamin submitted an Application for Material Testing Article 30 paragraph (1) and paragraph (2) of Law Number 30 of 2002 concerning the Corruption Eradication Commission against Article 1 paragraph (3), Article 27 paragraph (1), Article 28D paragraph (1, 2, 3), and Article 28I paragraph (2) of the 1945 Constitution of the Republic of Indonesia.

The application was submitted by Boyamin as a personal person, not as MAKI Coordinator.

"I hope (it will be decided) in less than a week, five, four days, three days, so hopefully it will be rejected or granted," said Boyamin.

Jokowi has signed the report file on the final list of names of candidates for leadership and the Supervisory Board of the Corruption Eradication Commission (KPK) for the 2024 '2029 period.

The files for the leadership candidate (capim) and supervisory board (dewas) reported by the selection committee have been signed since Monday (14/10) afternoon.
