Observers Ask Why Many Developers In South Tangerang Have Not Handed Over Fasum And Social Facilities
JAKARTA - A surprising fact came from the Disperkimta of South Tangerang City. They said that of the 200 housing developers recorded, only 45 of them had submitted PSU (public infrastructure, facilities, and utilities) or fasum fasum social facilities documents. Even a number of social and public facilities were commercialized by developers.
According to legal observer Fajar Trio, the developers did not comply with the applicable regulations related to the submission of the PSU, and even the potential for criminal acts of corruption. The rules that have been violated are the Minister of Home Affairs Regulation Number 9 of 2009 concerning procedures for submitting PSU, as well as Regional Regulation Number 3 of 2014 concerning the Implementation of Housing and Settlement Areas.
"This is a question mark as to why many developers in South Tangerang do not hand over social facilities. Some are even commercialized, it is clear that there is a criminal element, including the potential for criminal acts of corruption," Fajar said in Jakarta, Thursday, October 24, 2024.
Fajar also emphasized that in this case law enforcement officers must step in to investigate.
"The Prosecutor's Office must intervene to supervise, monitor and investigate the existence and function of social and public facilities in South Tangerang. Because this case of misuse of social facilities can develop into a corruption case," he said.

He reasoned that the public facilities or social facilities that had not been handed over to the municipal government could be misused for personal gain by developers and local government personnel who took care of their permits. In fact, he considered that the handover of public facilities and social facilities also added to the responsibility of the city government. As part of regional assets, public facilities and social facilities must be used properly to meet the needs of the residents.
"For this reason, the Prosecutor's Office should immediately investigate if there is a misappropriation of state assets. Because compliance with the regulations for handing over public facilities is very important to ensure the integration of sustainable housing development, as well as to improve services to the community in utilizing social and public facilities more comfortably," he said.
