Held Electronic-Based Grasion Dissemination, Criminal Director: Can Cut The Grasion Application Service Process

The Director of Crimes at the Directorate General of General Legal Administration (Ditjen AHU), Haris Sukamto, asked to immediately increase efficiency and effectiveness in the service of submitting a request for clemency and accelerating the granting of clemency considerations.

"We must immediately improve the application for clemency service as regulated in Article 17A," said Haris when opening a dissemination about Electronic-Based Grasion Services, Wednesday, October 23 at the Grand Mercure Hotel Malang.

Haris emphasized that the clemency application service that has been regulated in the Regulation of the Minister of Law and Human Rights (Permenkumham) Number 26 of 2023 concerning Amendments to the Regulation of the Minister of Law and Human Rights Number 49 of 2016 concerning Procedures for Application for Grasion which was set on October 20, 2023 as a high commitment of the government in supporting the development and improvement of the quality of clemency services through transparent and efficient digital transformation.

"With electronic clemency services, we can cut the time for the clemency application service process and performance or work results in accordance with the provisions of the applicable, time-measured laws and regulations, and have clear Standard Operating Procedures (SOPs)," he said.

He added that so far what has happened is the length of time for the completion of the review letter/migration consideration of the Minister of Law and Human Rights which exceeds 14 (fourteen) working days. The length of completion of the study/consideration is not in accordance with Article 17 of the Regulation of the Minister of Law and Human Rights Number 49 of 2016 concerning the Grasion of Application Application Procedures. This happened starting from the time the letter of application for clemency was received at the Ministry of Law and Human Rights to the preparation of the concept of a review letter/migration consideration which was still carried out conventionally/manually, through the bureaucratic chain from table to table from the level of the ministry leadership to the level of the conceptator.

"We will cut the chain of the clemency application process and give clemency legal considerations through electronic applications, in which the application process will be carried out electronically through the official website of the Directorate General of General Legal Administration," he added.

Meanwhile, the Head of the Regional Office (Kakanwil) of the East Java Ministry of Law and Human Rights, Heny Yuwono, hopes that the issuance of Permenkumham Number 26 of 2023 concerning Electronic-Based Grasion Services will strengthen governance in improving access to services to the community in terms of electronic-based clemency.

"We hope to deepen mutual understanding and unite steps in implementing these rules in all work units in East Java," he concluded.
