Ombudsman Finds Rp100 Million KUR Debtor Asked By BRI

The Ombudsman of the Republic of Indonesia found that there were debtors or parties who applied for People's Business Credit (KUR) who borrowed under Rp. 100 million but were required to be collateral by the Bank of the Republic of Indonesia (BRI)."As a result of monitoring the Ombudsman to MSMEs in Padang City, we found complaints about KUR debtors borrowing under Rp. 100 million but the bank required collateral," said RI Ombudsman Member Yeka Hendra Fatika in Padang, West Sumatra, Antara, Wednesday, August 14.Based on the results of the examination in the Ombudsman field, 12 BRI KUR debtors in the Padang City area were asked for collateral by the bank.In the findings, Yeka revealed that the collateral was also various, such as the motorcycle Motor Vehicle Owner's Book (BPKB) to the house certificate. The total collateral valuation of BRI KUR customers is estimated at Rp656 million.Yeka emphasized that the requirements made by the bank by detaining KUR customers who borrow under Rp. 100 million contradict Article 14 Paragraph 3 of the Coordinating Minister for the Economy Regulation Number 1 of 2023, concerning Amendments to the Regulation of the Coordinating Minister for Economic Affairs Number 1 of 2022 concerning Guidelines for Implementing KUR.The article states that additional collateral is not applied to borrowers under Rp. 100 million. In full, it is stated in Article 14 Paragraph 3 which states that additional collateral is not enforced for KUR with a loan ceiling of up to Rp. 100 million."So it can be ascertained that maladminitration occurs related to the retaining of the collateral," he said.On the one hand, he said that there was maladministration due to a lack of socialization related to Article 14 Paragraph 3 of the Coordinating Minister for Economic Affairs Regulation Number 1 of 2023 concerning Guidelines for Implementing KUR.
Therefore, the Ombudsman asked all banks, especially BRI, to socialize regulations regarding the implementation of KUR so as not to cause maladministration in the future for other debtors.
