Regarding Presidential Decree On Hasyim Asy'ari's Dismissal, Komnas HAM: There Is No Impunity Of Lowering Women Officials

JAKARTA - The National Human Rights Commission (Komnas HAM) responded to Presidential Decree (Keppres) Number 73P dated July 9, 2024 regarding the dishonorable dismissal of Hasyim Asy'ari as a member of the Indonesian General Elections Commission.

Deputy Chairman of Komnas HAM Pramono Ubaid Tanthowi in his statement in Jakarta, Thursday, hoped that the Presidential Decree could be a momentum in strengthening the government's commitment to fighting sexual violence.

"The Presidential Decree is expected to be a momentum for the government to strengthen its commitment to fighting acts of sexual violence that demean and discriminate against women's rights as victims and provide guarantees of justice for victims," said Pramono.

Komnas HAM also hopes that the Presidential Decree will serve as a reminder to every public official that they have an obligation to respect, protect, and fulfill the human rights of every citizen, especially the rights of women.

"With this Presidential Decree, there should be no more tolerance and impunity for any public official who is proven to have committed acts of sexual violence that demean women's dignity and dignity," said Pramono.

Komnas HAM urges election organizing institutions, both the KPU, the General Election Supervisory Body (Bawaslu) and the Election Organizers Honorary Council (DKPP) to immediately carry out the following three points.

First, implementing the Law on the Crime of Sexual Violence (UU TPKS) by formulating a policy commitment to prevent the crime of sexual violence in each institution.

"And it is stated in the form of KPU regulations, Bawaslu regulations, and DKPP regulations," added Pramono.

Second, form a task force in each election organizing institution to carry out the function of preventing and handling criminal acts of sexual violence.

"So that the KPU, Bawaslu, and DKPP as part of a democratic institution are safe and free spaces for women to carry out all their activities," he continued.

Third, conduct a thorough evaluation, both related to regulations, policies and behavior, to strengthen the commitment to fulfill women's political rights.

"Especially related to women's representation in the management of political parties, in the process of nominating the DPR/DPRD, as well as in the composition of KPU/Bawaslu at the provincial and district/city levels," concluded Pramono.

Earlier, Wednesday, July 10, Presidential Special Staff Coordinator Ari Dwipayana said that President Joko Widodo had signed the Presidential Decree on the dishonorable dismissal of Hasyim Asy'ari.

"The president has signed Presidential Decree No. 73P dated July 9, 2024 regarding the dishonorable dismissal of Hasyim Asy'ari as a member of the KPU for the 2022 '2027 term," said Ari Dwipayana.

The signing and issuance of the Presidential Decree follow up on the DKPP RI Decision and is in accordance with Law Number 7 of 2017 concerning General Elections. It is known, Wednesday (3/7), DKPP RI imposed a permanent dismissal sanction for Hasyim Asy'ari from the chairman position as a member of the Indonesian KPU as a result of immoral cases.
