Former Managing Director Of MRA Soetikno Soedarjo Sueded 6 Years In Prison For Garuda Aircraft Corruption Case

JAKARTA - Former President Director of PT Mugi Rekso Abadi (MRA) Soetikno Soedarjo was sentenced to six years in prison and a fine of Rp. 1 billion, subsidiary to six months in prison in the case of aircraft procurement at PT Garuda Indonesia.

"The defendant Soetikno Soedarjo was sentenced to six years in prison, reduced while the defendant was in detention with an order that the defendant remains in detention," said the prosecutor at the Corruption Court at the Central Jakarta District Court, reported by ANTARA, Thursday, June 27.

In addition, Soetikno Soedarjo was also required to pay compensation of 1,666,667.46 US dollars (US) and 4,344,363.19 European Union euros.

With the condition that if he does not pay the replacement money within one month after the decision has permanent legal force, then his property can be confiscated by the prosecutor to be auctioned off to cover the replacement money.

"If the convict does not pay or is not sufficient to pay the replacement money, he will be sentenced to three years in prison," said the prosecutor.

The prosecutor stated that the businessman was proven to have committed a criminal act of corruption as regulated and threatened with crime as referred to in Article 2 paragraph (1) in conjunction with Article 18 of Law Number 31 of 1999 concerning the Eradication of Criminal Acts of Corruption in conjunction with Article 55 paragraph (1) of the 1st Criminal Code.

According to the prosecutor, Soetikno's actions did not support the government in the context of eradicating corruption, so it was considered as burdensome.

"The defendant was polite during the trial, the defendant admitted and regretted his actions, the defendant was also the backbone of the family," continued the prosecutor reading out mitigating considerations.

In this case, Soetikno is considered proven guilty of conspiring with the former President Director (Director) of PT Garuda Indonesia Emirsyah Satar in the procurement of aircraft on the airline.

Emirsyah Satar, who is also a defendant in this case, is considered to have been proven without the right to hand over the plan to procure the PT Garuda Indonesia fleet (flat plan) to Soetikno.

The plan to procure fleets that were actually the company's secrets was then handed over to the Bombardier manufacturer.

Emirsyah is considered proven to have changed the plan for aircraft procurement needs from 70 seats to 90 seats, without first being stipulated in the company's long-term plan.

He is also considered proven to have ordered his subordinates to change the electoral criteria in the procurement of aircraft at PT Garuda Indonesia without the approval of the board of directors.

Emirsyah is also considered by the prosecutor to have been proven to have conspired with Soetikno Soedarjo as Bombardier and Avions De Transport Regional (ATR) commercial advisors to win Bombardier and ATR in the election for aircraft procurement at PT Garuda Indonesia.

In fact, Bombardier CRJ-1000 and ATR 72-600 aircraft do not comply with the business concept of PT Garuda Indonesia which provides full service.

The actions of the defendants, said the prosecutor, resulted in state financial losses at PT Garuda Indonesia with a total of 609,814,504 US dollars.

Previously, Soetikno had also been convicted in different cases. On May 8, 2020, he was sentenced to six years in prison plus a fine of Rp. 1 billion, subsidiary to three months in prison for being proven to have bribed Emirsyah Satar as President Director of PT Garuda Indonesia 2005 2014 and laundering money.
