Admits Business Discrimination And Courier Service, Shopee Undergoes A Behavior Change Session At The KPPU Assembly Session
JAKARTA - The Business Competition Supervisory Commission (KPPU) stated that it would closely monitor Shopee and Shopee Express operations after the two companies acknowledged a violation of unhealthy business practices and submitted behavioral changes.
Met by the media, the Head of the Public Relations Subdivision of KPPU, Intan Putri, in the middle of the third trial with reported Shopee and Shopee Express, explained that today's trial agenda is a response from the reported parties to the integrity pact points that will be agreed upon by the reported party and KPPU as regulated in KPPU Regulation Number 2 of 2023.
"So at the previous trial Shopee proposed a change in behavior, so today we have an integrity pact that must be completed by Shopee and Shopee Express. This means that if they apply for a change in behavior, it means that they agree to points in the integrity pact according to KPPU regulation number 2 of 2023 in Article 90," said Intan to reporters.
Shopee and Shopee Express are facing trial at the Business Competition Supervisory Commission (KPPU). PT Shopee International Indonesia (Reported 1) and PT Nusantara Express Lightning (Terlapor 2) acknowledged the alleged violation of courier services and submitted a request for behavior change in Case Number 04/KPPU-I/2024 concerning Allegations of Violation of Article 19 letter d and Article 25 paragraph (1) letter a of Law Number 5 of 1999 Related to Delivery Services (Kurir) on Shopee Platform.
Intan emphasized that Shopee and Shopee Express recognized discrimination in shipping services. Therefore, Shopee proposed a change in behavior.
"Indirectly, that's right (recognizing). Because the rules of the KPPU rules are like that, if you apply for a change in behavior, it means agreeing to the rules in the commission," said Intan.
After that, he said, the KPPU would form a supervisory board and closely monitor the behavioral changes proposed by Shopee for 90 days. If proven to be still carrying out unhealthy business behavior, the trial will continue and sanctions will be given.

During the next 90 days there will be supervision from the KPPU which must be reported to the commission assembly. So all reported parties must want to change behavior, one cannot, Shopee and Shopee Express submit behavior changes, so there are points to cancel the agreement, stop activities, stop the misuse of the dominant position and or pay fines due to the violations committed. So indirectly, the points should be approved by the defendants," he said.
On the other hand, Shopee and Shopee Express's attorneys as the reported party admitted that they would comply with all existing legal rules in Indonesia.
"We always comply with the existing laws in Indonesia. Later it will be better on July 2, 2024, everything is clearer," said the Shopee and Shopee Express Legal Team.
