Rizieq Shihab's Incitement To Make A Prisoner: I Invite All Habaib

JAKARTA - Prosecutors have exposed Rizieq Shihab's incitement so that a crowd appeared at the wedding of Rizieq's daughter and the commemoration of the Prophet's birthday in Petamburan, Central Jakarta. The prosecutor said the incitement started with Rizieq Shihab's invitation to stay in Tebet.

The prosecutor in the indictment explained that Rizieq Shihab on November 13, 2020, attended the Prophet's birthday in Tebet at around 04.30 Western Indonesia Time. The activity was attended by about 1,500 people.

"At the end of his lecture, he instigated the public to come and attend the commemoration of the Prophet's birthday and at the same time the wedding ceremony for his daughter in Petamburan, even though the defendant knew and realized that the DKI Jakarta area was in a pandemic condition and was being enforced by large-scale of social restrictions (PSBB), but the defendant incited the audience," said the prosecutor reading the indictment at East Jakarta District Court, Friday, 19 March.

Rizieq Shihab's incitement words as outlined in the indictment, namely:

"All who are here, God willing, tomorrow night in Petamburan we will hold a memorial for the birthday of the Prophet, brothers, and sisters, at the same time I invite all the habaib because we will also pair our fourth daughter. Ready to attend?," said Rizieq Shihab at that time. The defendant's incitement was repeated 3 times and still, the community answered "Ready".

The prosecutor classified this incitement as a criminal offense for violating the implementation of the Health Quarantine, considering that Jakarta is in a state of a health emergency.

"To ensure the implementation of the Prophet's birthday and the marriage of the defendant's daughter, Haris Ubaidillah uploaded a video to YouTube saying attend and broadcast the Maulid Akbar Nabi Muhammad SAW with FPI. The incitement of Haris Ubaidillah and the defendant conveyed to the public via YouTube is against the government's efforts to reduce the crowd so that the spread of COVID-19 does not arise," said the prosecutor.

Rizieq Shihab was charged with Article 160 of the Criminal Code in conjunction with Article 93 of Law Number 6 of 2018 concerning Health Quarantine in conjunction with Article 55 paragraph 1 to 1 of the Criminal Code and or Article 82 paragraph 1 in conjunction with Article 59 paragraph 3 letters c and d Law Number 16 of 2017 concerning Community Organization jo Article 55 paragraph 1 to 1 Criminal Code jo Article 10 letter b Criminal Code jo Article 35 paragraph 1 Criminal Code.
