Three Supreme Court Judges Who Decide The Age Limit For Candidates For Regional Heads Reported To KY
The three judges of the Supreme Court (MA) who decided regarding the minimum age limit for regional head candidates were reported by the Democracy and Constitutional Awareness Movement (Gradasi) to the Judicial Commission (KY).
"Our goal to KY is to report the three judges who yesterday made very odd decisions and injured the public, namely Yodi Martono Wahyunadi, Yulius, and Bright Bangun," said Director of Gradation, Abdul Hakim, quoted by ANTARA, Monday, June 3.
He mentioned three reasons for his party submitting a report to KY. The first reason is that according to them, the examination process by the Supreme Court was carried out in a very short time and seemed rushed.
"The examination time until the decision was only three days. We suspect this seems rushed. In general, if we look at the testing study at the Supreme Court, according to the PSHK study, the decision will take about 6 months and/or 50 months. What's wrong so fast? We should be suspicious," he said.
The second reason, his party assessed that the decision seemed prioritized. "If we are the ones testing in the field, usually the practice is old. (The decision) is like a priority. Our question is, why is it prioritized? For whom?" he said.
The last reason is that according to them, the decision is problematic because the minimum age limit for regional heads is set when they become candidates, not since they were sworn in.
The Gradation Coordinator, Zainul Arifin, said that they demanded that KY summon the three Supreme Court judges for questioning.
"We hope that KY will be open to the public to process public complaints according to the authority of KY," he said.

Meanwhile, contacted separately, a member and spokesman for KY, Mukti Fajar Nur Dewata, confirmed that KY had received a Gradation report.
He said the report would be processed according to procedures under the authority of KY to examine aspects of alleged violations of the Code of Ethics and Code of Conduct of Judges (KEPPH).
"If an alleged violation of the code of ethics is found, KY will examine the reported judge who will be decided in the plenary session whether it is proven or not proven to have violated the code of ethics," he said.

It is known that the Supreme Court in Decision Number 23 P/HUM/2024 granted the request of the Garuda Party regarding the minimum age limit for regional head candidates.
The Supreme Court stated that Article 4 paragraph (1) letter d of KPU Regulation (PKPU) Number 9 of 2020 contradicts Article 7 paragraph (2) letter e of Law (UU) Number 10 of 2016.
Therefore, the Supreme Court stated that the article in the PKPU does not have legal force as long as it does not mean "... he is at least 30 years old for governor and deputy governor candidates and 25 years for candidates for regent and deputy regent or deputy mayor or deputy mayor since the pair of candidates was elected".
At the end of its decision, the Supreme Court also ordered the Indonesian KPU to revoke Article 4 paragraph (1) letter d of PKPU Number 9 of 2020.
