DKPP Gives Sanctions To Warning KPU For Leaks In DPT 2024 Election
JAKARTA - The Election Organizers Honorary Council (DKPP) has decided to impose sanctions in the form of warnings to the chairman and ranks of the General Elections Commission (KPU) over the lawsuit for the 2024 Election Fixed Voter List (DPT) which was allegedly leaked at the end of 2023."Imposing a warning sanction to Teradu Hasyim Asy’ari as Chairman concurrently Member of the General Elections Commission, Defendant II Mochammad Afifuddin, Defendant III Betty Epsilon Idroos, Defendant IV Parsadaan Harahap, Teradu Yulianto Sudrajat, Defendant VI Idham Holik, and Defendant VII August Mellaz each as a member of the General Election Commission as of this decision was read out," said DKPP Chairman Heddy Lugito reading the verdict in the code of ethics trial as quoted from a copy of the verdict in Jakarta, Antara, Wednesday, May 15.Meanwhile, DKPP member I Dewa Kade Wiarsa Raka Sandi emphasized that the defendants should follow up by following up on the provisions of Article 46 of Law Number 27 of 2022 concerning Personal Data Protection.He also said that the KPU's pretext of assuming the alleged data leak could not be proven because the Police investigation could not be justified according to the ethics of election organizers."The Pretext of the Defendants that the alleged leak of the Voters' data cannot be proven because the Bareskrim Polri is still carrying out the investigation stage, it is not justified according to the ethics of the election organizers. Thus, the complaint argument for the complainants at [4.1] is proven and the answers of the Defendants do not convince the DKPP," said Raka.The regulation explains that private data controllers are obliged to submit written notifications no later than 3x24 hours to personal and institutional data subjects in the event of a failure to protect personal data.DKPP assesses that Hasyim and his staff should make notifications to the public as a form of public accountability."This is in line with the principles of honestness, legal certainty, order, openness and accountability as election organizers," he said.To note, Hasyim and six other members of the Indonesian KPU were complained by Rico Nurfiansyah Ali with case Number 4-PKE-DKPP/I/2024.
The Defendants were proven to have violated the provisions of Article 6 paragraph (2) letter d, Article 6 paragraph (3) letter d, Article 9 letter a, Article 11 letter a and letter c, Article 12 letter e, Article 13 letter c, Article 16 letter b and letter e of the Honorary Council Regulation of Election Organizers Number 2 of 2017 concerning Code of Ethics and Code of Conduct of Election Organizers.
