Otto Hasibuan: Judge Don't Consider Amicus Curiae

JAKARTA - A member of the Prabowo-Gibran Defenders Team, Otto Hasibuan, said that the constitutional judge did not consider the opinion of amicusftiae or a friend of the court in determining the decision on the Dispute on the Results of the General Election (PHPU) of the President and Vice President 2024. Although, everything has been read.

"Obviously we saw the court firmly stating that we had read all the petitioners' petition from amicusurikae but we did not see the court considering all opinions rather than the amicus theft," Otto told reporters at the Constitutional Court (MK), Monday, April 22.

Otto assessed that the many emerging amicus theft could potentially be a tool for intervention. Thus, the court did not use it to determine the verdict. "But this is an opinion, yes, if it is allowed to develop this amicus theft in every court, it may potentially become an intervention to the court or to the courts, but that is my personal opinion, but maybe that's why the constitutional court does not consider it," he explained.

With the Constitutional Court's decision, Otto said this indirectly ensured that Prabowo-Gibran would officially become the next President and Vice President of Indonesia.

Moreover, there were no other legal remedies after the decision from the Constitutional Court.

"So Prabowo Subianto officially becomes President of the Republic of Indonesia as well as Gibran Rakabuming Raka officially becomes the vice president of Indonesia and we respect this and there are no more legal remedies against this decision," said Otto.

The Constitutional Court decided to reject the Ganjar-Mahud and Anies-Muhaimin Iskandar or Cak Imin petition regarding the Dispute over the 2024 Presidential and Vice Presidential General Election Results (PHPU).

"Reject the applicant's application in its entirety," said Chief Justice of the Constitutional Court Suhartoyo.

In the decision of the two petitions, there were three constitutional judges who stated the dissenting opinion. They are, Saldi Isra, Enny Nurbaningsih, and Arief Hidayat.
