The Corruption Eradication Commission (KPK) Said Officials Can Receive Hampers From Their Core Families As Long As There Is No Conflict Of Interest

JAKARTA - The Corruption Eradication Commission (KPK) said officials may accept gifts in the form of parcels or hampers from the nuclear family. This is based on the Corruption Eradication Commission (Perkom) Regulation Number 2 of 2019 concerning Gratification Reporting which regulates 17 gratuities that are not mandatory to be reported.

"17 types of gratification that are not mandatory to be reported to the KPK, namely gifts in the family, namely grandfather or grandmother; father, mother, mother-in-law; husband or wife; son or son or son-in-law; legal or guardian; grandson; besan; uncle or aunt; brother, sister, or sister-in-law; cousin and nephew as long as there is no conflict of interest," said KPK Spokesperson for Prevention Ipi Maryati to reporters, Monday, April 8.

Officials can also receive parcels or hampers from colleagues, said Ipi. However, the value is at most Rp. 200 thousand per person and in accumulation it cannot be more than Rp. 1 million from the giver in one year.

This provision is also not allowed in the form of money or other medium of exchange and must be ensured not to be related to service.

"However, this provision does not apply to other parties who are not co-workers," he said.

"During the granting of gratuities, it is given to state officials or civil servants by remembering or dealing with their positions and contrary to their obligations or duties or having potential conflicts of interest, regardless of the value, gratification recipients are required to report to the KPK," said Ipi.

Ipi reminded that gratification has a broad meaning based on Article 12B of Law Number 20 of 2001. "That includes the provision of free money, goods, rebates or discounts, interest-free loan commissions, travel tickets, lodging facilities, tourist trips, free treatment and other facilities," he said.
