Dasco Invites PDIP To Sue KPU To Administrative Court, Optimistic Prabowo-Gibran To Remain Elected President-Vice President

JAKARTA - The daily chairman of the Gerindra Party DPP, Sufmi Dasco Ahmad, responded to the PDI-P who sued the General Elections Commission (KPU) to the State Administrative Court (PTUN). Dasco invited PDIP to exercise the rights stipulated in the law."Yes, it is done like the Constitutional Court or then the Administrative Court is a right and is guaranteed by law. Because based on the facts on the ground, said Dasco, the majority of Indonesia's population did choose Prabowo-Gibran."But we still believe that whatever it is on the basis, both from the number of votes and based on the existing law, Prabowo-Gibran, God willing, will be appointed president and vice president elected to the Republic of Indonesia," said Dasco.It is known that the PDI-P (PDIP) through the Indonesian Democratic Struggle Team (PDI) filed a lawsuit with the State Administrative Court (PTUN). The General Election Commission (KPU) became the defendant."The point of the type of lawsuit is an unlawful act by the state apparatus, the defendant KPU," said former Supreme Court Judge (MA) Gayus Lumbuun, who was the leader of the PDI Team in the Administrative Court, Cakung, East Jakarta, Tuesday, April 2.Gayus revealed that the act against the law committed by the KPU was to pass Gibran Rakabuming Raka as the vice presidential candidate accompanying Prabowo Subianto in the 2024 presidential election. This institution is considered to have violated the law because it contradicts the principles and norms in the general election (election).Complementing Gayus' statement, Erna Ratnaningsih, a member of the PDI team said that the KPU still used the old rules when it received Gibran's candidacy. The KPU only issued PKPU Number 23 of 2023 on November 3 or a week after receiving Gibran's registration. “ In this case, when the KPU received registration, the KPU still used the old regulations, PKPU Number 19 of 2023,” he said."This means that the KPU's actions violate legal provisions, violate legal certainty where it imposes a retroactive regulation," Erna continued.
