Margarito Thursday To The Anies-Ganjar Camp: It's Lost And Has Just Been Noisy, Isn't It Fair!

JAKARTA - Expert from the Prabowo-Gibran team, Margarito Thursday in his legal presentation questioned why the Anies-Muhaimin and Ganjar-Mahfud pairs only questioned Gibran's candidacy as vice presidential candidate at the Constitutional Court hearing.In fact, after the Constitutional Court's decision Number 90/PUU-XXI/2023 regarding the requirements for the age of the presidential and vice-presidential candidates, Gibran's registration was declared valid."The legal basis has changed, the law has changed, the registration is valid. Why is it not disputed? Already lost, then made a fuss. It's not fair," said Margarito at the Constitutional Court hearing, Thursday, April 4.Margarito also admitted that he was surprised why the Anies and Ganjar camps considered Gibran's candidacy to be invalid because the KPU had not issued a KPU regulation that followed up on the Constitutional Court's decision when receiving Gibran's candidacy.According to him, when the rules regarding the age requirements for presidential and vice-presidential candidates in Law Number 7 of 2017 concerning Elections have been amended through the Constitutional Court's decision, these regulations have valid even though there are no derivative rules."If the legal basis changes, the law (also) changes. The terms are regulated in Article 169 (Ection Law). That article is tested here, given a different interpretation, then basically changes, the law changes," said Margarito.On that occasion, Margarito was also of the view that the petitum of Anies-Imin and Ganjar-Mahfud's lawsuit asking the Constitutional Court to disqualify Prabowo-Gibran from the 2024 presidential election could not be realized.Because, according to him, there must be concrete evidence revealed in the argument of the lawsuit to be able to prove fraud in the implementation of the election."So, it cannot be disqualified, whether you like it or not, happy or not. The law says there is no business with likes and dislikes. The law forces us to be objective," he said.In detail, the experts presented by the Prabowo-Gibran camp in today's trial included Professor of Constitutional Science at Pakuan University, Andi muhammad Asrun; Law expert, Abdul Khair Ramadhan; Professor of the Faculty of Law, Hasanuddin University, Aminuddin Ilmar; and constitutional law expert Margarito Thursday.Then, the Dean of the Faculty of Management of the IPDN Government, Khalil khairi; Professor of Criminal Law at Gadjah Mada University and former Deputy Minister of Law and Human Rights, Edward Omar Sharif Hiariej, Founder of the Cyrus Network survey institute, Hasan Hasbi; and Executive Director of Indo Baroemeter, Muhammad Qodari.
As for the witnesses, there were six people presented, Chairman of Commission II of the House of Representatives Ahmad Doli Kurnia; Deputy Chairman of Commission VIII of the House of Representatives Ace Hasan Syadzily; Gani Muhammad; Andi Bataralifu; Tanjung Suprianto; and Abdul Wahid.
