Defendant Of Deadly Accident In Ambon Sentenced To 9 Years In Prison, SIM Revoked 5 Years
AMBON - The Ambon District Court judges sentenced Kresna to nine years in prison for a fatal accident that caused the victim to die.
"To declare the defendant guilty of violating Article 311 paragraph (5) of the Republic of Indonesia Law Number 22 of 2009 concerning road traffic and transportation and imposing a sentence of nine years in prison," said Chief Justice Orpa Marthina accompanied by two member judges at the Ambon District Court as reported by ANTARA, Tuesday, April 2.
In the verdict, the panel of judges stated that the person concerned remained in detention and the defendant's right to obtain a driving license (SIM) was also revoked for five years.
There are also things that incriminate the defendant being sentenced to prison because his negligence caused the victim Victor Arthur Lucas, who was an employee of the West Seram District Attorney's Office, to die.
Meanwhile, the mitigating factor is that the defendant is polite and has never been convicted.
The judge's decision is also the same as that of the Ambon Prosecutor's Office, Novi Temar, who demanded that the defendant be sentenced to nine years in prison and the defendant's right to obtain a driver's license was also revoked for five years.

The prosecutor said the fatal accident that occurred on Friday (28/9/2023) at around 05.00 WIT occurred on Jalan Suli Atas, Salahutu District (Ambon Island), Central Maluku Regency.
The defendant, who had just returned from a recreation activity in the Tulehu hot bath, was about to go to Ambon City while driving his city transportation (angkot) at high speed hitting the victim who was in the opposite direction.
"While driving the vehicle, the defendant was already under the influence of the liquor that was consumed with his colleagues while at the Tulehu hot bath," explained the Public Prosecutor.
