Ferrari Sued To Court For Not Solving The Problem Of Brake Oil Leaks
JAKARTA - A luxury sports car manufacturer from Italy, Ferrari has been sued in the United States by one of the owners of its vehicles. This lawsuit was filed because Ferrari was deemed to have failed to repair vehicles at risk of losing part or all of its braking capabilities.
Reported by Reuters on March 19, the lawsuit was filed by Iliya Nechev, a resident of San Marcos, California, who bought the 2010 Italian 458 Ferrari in 2020.
"almost had an accident several times," Nechev said.
He called the problem because of his Ferrari brakes, but the dealer instead said the brakes were normal and he had to be "ordinary to the incident."
Nechev said he wouldn't have bought the Ferrari had he known about the matter.
Meanwhile, according to a class action note filed on Monday, March 18, in the San Diego federal court, the recall that Ferrari made in 2021 and 2022 to tackle the leakage of brake oil was just a temporary measure. This actually allows Ferrari to keep selling thousands of cars with defective brakes.
The lawsuit also states that the only repair only replaces the damaged cylinder master when the leak is found.
"Ferrari is legally required to disclose brake defects as a known safety flaw and fail to do so," reads the lawsuit, asking for unspecified compensation for its motorists.
In a statement on Tuesday, March 19, Ferrari did not specifically discuss the lawsuit but said that their "highest priority" was the safety and well-being of motorists.
"We operate in accordance with strict safety and security guidelines to ensure that our vehicles always meet homologation specifications," added Ferrari.

It is known, Ferrari issued brake recalls in several countries including the United States and China starting October 2021.
The recall in the US includes many Ferrari models, including 458 and 488 versions, which were produced for nearly two decades.
Ferrari and Bosch from Germany, a parts supplier suspected of being disabled, said the problem could occur due to a brake oil reservoir lid that may not be well ventilated, potentially creating a vacuum inside the reservoir.
In this lawsuit, not only Ferrari but Bosch is also listed as a defendant.
