Mahfud Regarding Election Lawsuits In The Constitutional Court: Many Can Prove Fraud To Disqualify Their Victory
JAKARTA - Vice Presidential Candidate number three, Mahfud MD said the existence of evidence to handle allegations of structured, systematic, and massive fraud (TSM) in a dispute over general elections at the Constitutional Court (MK) was needed. Because, if it is proven that it is not impossible that someone's victory could be disqualified.
This was conveyed by Mahfud when opening a discussion session on his official X or Twitter account, @mohmahfudmd. Initially there was a netizen who asked him about the party who filed the lawsuit but was not accompanied by sufficient evidence.
"Is there a consequence on the legal route via the Constitutional Court, where to file a lawsuit but actually lacks a lot of energy; the evidence is insufficient, sir," asked a netizen with the @QiuQiu_Official account.
Responding to this, Mahfud said that he often found something similar when he was still the Chief Justice of the Constitutional Court and tried the election lawsuit. "Many are like that," he said, starting his tweet.
"A big bear, lack of lust because the plaintiff was only angry but had no evidence," continued Mahfud.
As a result, they lost in court so they could not prove the fraud. "So the winner still wins," said the former Coordinating Minister for Political, Legal and Security Affairs (Menko Polhukam).

However, on the other hand, many are also said to be able to prove fraud in court. Thus, the verdict handed down starts from disqualification to a re-election order.
"But many can also prove TSM fraud so that the verdict disqualifies the winner or re-election order for certain areas. It depends on the evidence and the courage of the judge to carry out judicial activities," Mahfud explained.
As previously reported, Mahfud said that there are two official channels to resolve the chaos of the 2024 General Election which are suspected of fraud. Apart from going through politics by applying for the right of inquiry in the DPR RI, it is also possible to file a lawsuit to the Constitutional Court.
For the right of inquiry, he said, it is the right of election participants from political parties. Meanwhile, he, who is not from the party, can sue for election fraud through the Constitutional Court.
