Bareskrim Delegates Tiktokers Spread Hate Speech About Papua To The DKI Prosecutor's Office
The Criminal Investigation Unit of the National Police has transferred files and suspects in the alleged hate speech case regarding Papua TikTokers Aperlinus Bu' Ulolo to the DKI Jakarta High Prosecutor's Office (Kejati).
Delegation or stage two is carried out after the case file is declared complete by the research prosecutor.
"The investigation into the alleged criminal act of hate speech based on SARA carried out by the owner, user and who controlled TikTok social media accounts with the username @presiden_ono_niha/Jay Komal has been declared complete by the DKI Jakarta High Prosecutor's Office, as received by the P21 letter from the public prosecutor with one suspect on February 7, 2024," said Head of the Public Relations Division of the National Police Public Relations Division Kombes Erdi A. Chaniago in his statement, Thursday, February 22.
Phase two or delegation of suspects and evidence was carried out on Thursday, February 22, 2024.
Some of the pieces of evidence that were also transferred were ID cards on behalf of the suspect, tiktok social media accounts @presiden_ono_niha, email accounts, blue oppo cellphones, sweaters or fake hair, blue t-shirts, black blazer and one black eyeglass.
"The suspect plays the owner, user and who controls the TikTok social media account @presiden_ono_niha who creates video content with a duration of 2 (two) minutes, and also the one who posted the video content on his TikTok social media on December 30, 2023," he said.
In this case, Aperlinus Bu'Ulo was charged with Article 45A paragraph (2) in conjunction with Article 28 paragraph (2) of Law Number 9 of 2016 concerning Amendments to Law Number 11 of 2008 concerning Information and Electronic Transactions and/or Article 16 in conjunction with Article 4 letters b number 1 and 2 of Law Number 40 of 2008 concerning Elimination of Racial and Ethnic Discrimination and/or Article 156 of the Criminal Code with a maximum penalty of 6 years in prison and a maximum fine of IDR 1 billion.

As a reminder, Papua Police Chief Inspector General Mathius Fakhiri said Aperlinus Bu Ulolo had been arrested by the Bareskrim cyber team in the West Jakarta area, Saturday, December 30 evening.
"It is true that the AB who has been arrested by the Bareskrim cyber team related to hate speech against supporters of the former Papua Governor, the late Lukas Enembe, was uploaded to his TikTok account. The investigation is still ongoing and is currently still waiting for further information from the Criminal Investigation Unit of the National Police Headquarters," said Fakhiri.
The arrest was made after a report was made regarding the owner of the Tiktok account @presiden_ono_niha who uploaded hate speech and contained SARA against Enembe supporters. From that report, an investigation was carried out until the account owner was found.
