Respect The Status Of Suspect Eddy Hiariej Canceled By South Jakarta District Court, KPK: Determination Based On 2 Evidences Fulfilled
JAKARTA - The Corruption Eradication Commission (KPK) respects the attitude of the South Jakarta District Court (PN) Panel of Judges which canceled the determination of the suspect former Deputy Minister of Law and Human Rights Edward Omar Sharif Hiariej or Eddy Hiariej. However, they will study the decision.
"In principle, our attitude towards every decision of the panel of judges respects it, including in the pretrial of alleged bribery and gratuities involving the Deputy Minister of Law and Human Rights EOSH," said Head of the KPK News Section Ali Fikri to reporters in a written statement, Tuesday, January 30.
"However, the KPK will wait for the minutes of the complete verdict of this pretrial trial for us to study in order to determine the next legal steps," he continued.
Ali said the anti-corruption commission certainly already had two pieces of evidence in determining the suspects, including Eddy Hiariej. "We have obeyed this," he said.
Moreover, this pretrial concerns the formal side of the determination of the suspect. So that it does not change Eddy's role in the bribery and gratification cases that ensnared him, said Ali.
"This pretrial trial object only concerns the side of the formal requirements so that of course it does not involve the substance or main material of the case," said the spokesman with the background of the prosecutor.
As previously reported, the KPK lost the pretrial lawsuit against Eddy Hiariej. The sole judge decided to determine the suspect in the case of alleged bribery and illegal gratification.
"The judge reached the conclusion of the defendant's actions which determined the applicant as an invalid suspect and had legal force," said Judge Estiono when reading the verdict, Tuesday.
The judge considers that the anti-corruption commission does not have enough evidence in determining the suspect as regulated in Article 184 paragraph 1 of the Criminal Procedure Code (KUHAP).
Then, the judge assessed that the article used by the KPK for the determination of the suspect against Eddy Hiariej did not have binding legal force.

Meanwhile, the articles used by the KPK are Article 12 letter a or Article 12 letter b or Article 11 of Law Number 31 of 1999 concerning Eradication of Criminal Acts of Corruption as amended by Law Number 20 of 2001 concerning Amendments to Law Number 31 of 1999 concerning Corruption in conjunction with Article 65 of the Criminal Code.
"The trial, in the exception, stated that the defendant's exception could not be fully accepted," said Judge Estiono.
