Government Targets Regulations For Personal Data Protection Supervisory Institutions To Be Completed By The End Of June 2024
JAKARTA - The Ministry of Communication and Information (Kominfo) targets the establishment of a personal data protection supervisory agency (PDP) to be completed in the second quarter (Q2) or the end of June 2024.
"According to the mandate of the law, we have prepared a new institution through the Presidential Regulation. The draft is already there, just wait for the schedule, our target for Q2 this year can be completed, so the Presidential Decree regulates the new institution," said Director General of Informatics Applications of the Ministry of Communication and Information Semuel Abrijani Pangerapan at the Ministry of Communication and Information Office, Central Jakarta, Friday, January 26, confiscated by Antara.
The personal data protection supervisory agency will carry out its duties as stated in Law number 27 of 2022 concerning Personal Data Protection (PDP). In the regulation, Article 58 paragraph 2 states that the PDP supervisory agency is tasked with not only establishing policies and strategies to protect people's personal data, but also enforcing the administrative law of the law.
Semuel said the institution would be independent and immediately under the President.
The PDP Law contains 16 chapters and 76 articles which were inaugurated in the 2022 quarter, precisely in September 2022 by the Indonesian House of Representatives and the Ministry of Communication and Informatics.

After being ratified, the Ministry of Communication and Informatics has prepared two derivative rules to complete the PDP Law. In the third quarter of 2023, the public is invited to take part and provide input on the implementing regulations, namely the Draft Government Regulation concerning Personal Data Protection (RPP PDP).
RPP PDP is a derivative rule of Law (UU) number 27 of 2022 concerning Personal Data Protection (PDP) which has been prepared since the regulation was passed in 2022.
Currently, the implementation of the PDP Law is in a transition period for two years before the regulation is actually implemented and is fully enforced in October 2024.
During the transition period, personal data controllers, personal data processors, and other related devices, both from the public and private sectors, are asked to study to prepare technical implementations in each institution.
