Defendant Of Corruption Metrology Equipment Of The Dompu Trade Office Sentenced To 17 Months In Prison

The Panel of Judges at the Corruption Court at the Mataram District Court, West Nusa Tenggara (NTB) sentenced Iskandar to 1 year and 5 months in prison, a technical activity executive official (PPTK) for the procurement of metrological equipment at the Dompu Industry and Trade Office.

"The trial, sentenced the defendant Iskandar to 1 year and 5 months in prison and a fine of Rp. 100 million, subsidiary to 4 months in prison," said Chief Justice I Ketut Somanasa reading the verdict of the case belonging to the defendant Iskandar at the Corruption Court at the Mataram District Court as reported by ANTARA, Tuesday, December 5.

The panel of judges declared the crime by stating that the defendant's actions as PPTK had been proven to have violated the indictment of the public prosecutor's subsidiary.

The indictment relates to Article 3 in conjunction with Article 18 of Law Number 31 of 1999 concerning the Eradication of Criminal Acts of Corruption as amended by Law no. 20 of 2001 jo. Article 55 paragraph (1) of the 1st Criminal Code.

Regarding the state financial losses that emerged, the panel of judges agreed with the results of the NTB Inspectorate audit of Rp398 million.

However, in the case belonging to the defendant Iskandar, the panel of judges did not find any facts at the trial stating that the defendant Iskandar received and/or took advantage of the state's financial losses.

"Because there is no fact that the defendant has received profits from this case, the panel of judges does not need to charge the defendant in compensation for state financial losses," he said.

From the description of the case decision, the panel of judges also conveyed considerations in imposing a crime against the defendant who served as Head of the Trade Division at the Dompu Disperindag.

"In the procurement of metrological tools complete with other facilities and infrastructure that will run in the 2018 fiscal year, the defendant as PPTK is not careful in carrying out his duties so that irregularities occur in the procurement process," he said.

In addition, the emergence of state financial losses from this procurement only had an impact on the district area so that the panel of judges stated that the defendant's criminal acts were categorized as light.

After listening to the reading of the verdict, the defendant and the public prosecutor had not yet expressed their position, so the judge gave a time limit of up to seven days since the verdict was read.

The implementation of the procurement of metrology tools complete with other facilities and infrastructure runs using the Dompu APBD of around Rp. 1.42 billion.

The procurement was carried out by another defendant, namely Yanrik, who received power as project implementer of CV Fahriza based in Dompu Regency.
