The Fate Of Anwar Usman And Other Constitutional Court Judges Will Be Decided On November 7
JAKARTA - Chairman of the Honorary Council of the Constitutional Court (MKMK) Jimly Asshiddiqie said his party would decide on alleged violations of the code of ethics of Chief Justice of the Constitutional Court Anwar Usman and 8 other Constitutional Court judges on Tuesday, November 7, 2023.
Jimly said that his party made the decision after considering the requests of the reporters in the alleged violation of the constitutional judge's code of ethics related to the handling of material testing cases on the provisions of the minimum age limit for presidential and vice presidential candidates in Law Number 7 of 2017 concerning Elections.
"We have agreed on the decision on 7 (November 2023) and in addition, this is also for the purpose of ensuring that our political society gets legal certainty and justice. The legal certainty is fair so that we don't go anywhere again thinking after the Constitutional Court's decision," said Jimly.
Jimly said a number of reporters in cases of alleged violations of the judge's code of ethics asked his party to decide the case before November 8, 2024. The reason is, November 8 is the last day of changing the name of the presidential and vice-presidential candidates.
"On the 8th (November 2023) it's the last chance to change the candidate pair, right. We discussed it. The conclusion is that we fulfill the request. So we plan this decision to be completed on the 7th," said Jimly.
"Why on the 7th, because we want to make sure that no impression arises, for example, if someone thinks that this is deliberately being delayed. Even though this is actually too fast, it's already working. Our task is 30 days should be, only someone will be able to think that this Waduh is deliberately delayed," added Jimly.
Karena itu, kata Jimly, pihaknya akan memeriksa secara cepat para pelapor dan 9 hakim MK sebagai pihak terlapor. Para pelapor, kata dia, akan diperiksa secara terbuka, sementara 9 hakim MK akan diperiksa satu atas secara tertutup sesuai dengan hukum acara pemeriksaan dugaan pelanggaran kode etik hakim MK.
"Because the PMK regulation is closed. The law of the event says it is closed. But what have we done? It is closed as long as it involves the judge, but as long as the reporter is concerned, we will open up the mutual agreement," he said.

Until now, said Jimly, there have been 18 reports of alleged violations of the code of ethics of the 9 judges of the Constitutional Court. He ensured that the Constitutional Court would continue to prioritize the principles of prudence and professionalism in handling the case, even though it was carried out in a relatively short time.
"We've been very careful with this. Very careful. So we've learned all the substances are similar. So it's just a matter of proof in court. This can be simplified, don't be too complicated, it's complicated, this is a tension that arises because there is already a political grouping," concluded Jimly.
