Defendant Of Rape To Death Sentenced To Judge Of Ambon District Court 12 Years In Prison
AMBON - The Ambon District Court (PN) panel of judges sentenced Muhammad Rumagia to 12 years in prison who was accused of sexual intercourse until the victim died due to bleeding on Banda Neira Island, Central Maluku Regency.
"The defendant is legally and convincingly guilty of committing a criminal act with violence or threats of violence forcing a woman to have sex with her outside of marriage according to the second alternative indictment Article 285 of the Criminal Code," said the chairman of the panel of judges Orpa Marthina accompanied by Rahmat Selang and Ismael Wael as member judges in Ambon as reported by ANTARA, Tuesday, October 10.
"Imposing the expected sentence of Muhammad Rumagia alias Amat with a prison sentence of 12 years and deducting the entire sentence that has been served by the defendant," continued the judge.
The aggravating thing was that the defendant was sentenced to prison because his actions had resulted in the victim's death, while what was mitigating was that the defendant was polite and had never been convicted.
The judge's decision was higher than the demands of the Central Malteng Prosecutor's Office, Yunita Sahetapy, who in the previous trial demanded the defendant to be in prison for 10 years.

After listening to the judge's verdict, the defendant Muhamad Rumagia alias Amat immediately appealed the judge's verdict.
The defendant committed rape at the victim's house in one of the villages on Neira Island, Banda District, Malteng, Maluku, Monday (20/3).
The victim, NA (30) suffered a severe bleeding until she was unconscious after experiencing sexual violence from the perpetrator. The victim was rushed to Banda Hospital for medical treatment, but at around 23.00 WIT, his life could not be saved.
