Corruption Of Waste Retribution, Former Head Of DLH Bandar Lampung Divonis 6 Years In Prison

LAMPUNG BANDAR - Former Head of the Bandar Lampung Environment Agency (DLH) Sahriwansah was sentenced to six years in prison by a panel of judges at the Tanjungkarang Class 1 A District Court, Bandar Lampung.

"Sentenced Sahriwansah to six years in prison and a fine of Rp. 300 million. If the fine is not paid, a six-month prison sentence will be replaced," said Chief Justice Lingga Setiawan in a trial reported by ANTARA, Thursday, September 21.

The judge also sentenced the defendant with compensation of Rp4,395,800,000 minus Rp2,695,200,000 which had been returned to the State Treasury.

"So the compensation for state losses that must be paid by the defendant is Rp. 1,700,600,000 at a maximum one month after this decision obtains a permanent law," he said.

The judge also said that if the defendant did not pay the replacement money, his property could be confiscated by the prosecutor and auctioned off to replace the replacement money.

"With the provision that if you do not have sufficient property, you will be sentenced to one year," he said.

In its decision, Chief Justice Lingga Setiawan stated that the defendant Sahriwansah was found guilty of violating the provisions of Article 2 Paragraph (1), Juncto Article 18 Paragraph (1), Law of the Republic of Indonesia Number 31 of 1999 concerning the eradication of criminal acts of corruption.

Previously, two other defendants, Haris Fadillah as the Head of the Bandar Lampung DLH Division, were sentenced to 4 years in prison, and Hayati as the collector of the Bandarlampung DLH waste levy was sentenced to 5 years in prison by the Panel of Judges at the Class 1 A Tanjungkarang District Court, Bandar Lampung.

It is known that the Public Prosecutor (JPU), charged the former Head of the Bandarlampung Environmental Service (DLH), Sahriwansah, for two years and six months in prison in connection with the alleged criminal case of corruption in waste retribution.

After that, the Public Prosecutor also demanded that the defendant Sahriwansah pay a fine of Rp. 500 million, subsidiary to six months in prison. Sahriwansah was also sentenced to an additional penalty in the form of payment of compensation of Rp. 3.86 billion. However, he has paid state losses of Rp. 3.89 billion so that the remaining money that has been paid is Rp. 27 million and will be returned to the defendant.
