LPSK Highlights Victim's Rights To Restitution After Ferdy Sambo's Cassation Verdict
JAKARTA - The Witness and Victim Protection Agency (LPSK) highlighted the rights of victims, in this case Brigadier Nofriansyah Yosua Hutabarat, to apply for restitution or compensation after the Supreme Court's cassation decision on Ferdy Sambo and three other defendants.
"On the cassation decision, LPSK is of the view that the victim's family or the victim's heirs actually have the right to apply for restitution or compensation to the convicts," said Deputy Chairperson of LPSK Maneger Nasution as reported by ANTARA, Thursday, August 10.
Regulation of the Supreme Court (Perma) Number 1 of 2022, said Nasution, has regulated the procedural law regarding the application for restitution after a decision has permanent legal force or commitment.
Nasution explained that the application for restitution could be submitted by the applicant/expert of the victim's heir or through LPSK.
Nasution emphasized that the decision to apply for restitution was returned to the victim's family because restitution was the right of the victim or the victim's family.
"Then the decision will apply or not to apply (restitution), absolutely is their right," he said.
Nasution reminded that the restitution application was limited to 90 days after the Petitioner found out that the court's decision had permanent legal force, as stipulated in Perma Number 1 of 2022.
Previously, the Supreme Court sentenced former head of the Professional and Security Division of the National Police Ferdy Sambo to life imprisonment, from the death penalty.

Meanwhile, Putri Candrawathi, who is Ferdy Sambo's wife, was sentenced to 10 years in prison, from the previous 20 years.
Ricky Rizal's sentence has also become lighter, namely eight years in prison, from the previous 13 years, and Strong Ma'ruf from who was previously sentenced to 15 years in prison, to 10 years.
The decision was conveyed by the Head of the Legal and Public Relations Bureau of MA Sobandi at a press conference at the MA Building, Jakarta, Tuesday (8/8), after the closed trial which started at 13.00 to 17.00 WIB.
The panel of judges who decided the cassation case were Suhadi as chairman of the assembly, with four members of the panel including Suharto, Jupriyadi, Desnayeti, and Yohanes Priyana.
Sobandi said the Supreme Court's decision had been signed. Even so, the defendant can still take extraordinary legal action by submitting a review.
