Coordinating Minister For Political, Legal And Security Affairs For Land Mafia Cases Dispute Of PTPN II Deli Serdang Land, North Sumatra
Coordinating Minister for Political, Legal and Security Affairs Mahfud MD together with representatives of the Attorney General's Office and the North Sumatra High Prosecutor's Office dissected the alleged land mafia case in a land dispute belonging to PT Perkebunan Nusantara II in Deli Serdang, North Sumatra.
"We are examining the case against the decision of the Lubuk Pakam District Court, North Sumatra, regarding state land in Tanjung Morawa, Deli Serdang, covering an area of 464 hectares. It originally belonged to PTPN II, suddenly at PN (Lubuk Pakam) was defeated," Mahfud said at a press conference at the Coordinating Ministry for Political, Legal and Security Affairs Office, Jakarta, reported by ANTARA, Tuesday, July 18.
Mahfud explained that the case surgery that had been carried out at the Coordinating Ministry for Political, Legal and Security Affairs Office for about two hours was carried out as the government's commitment to maintaining state assets, as directed by President Joko Widodo.
He conveyed that the case began with a civil lawsuit from the community, totaling 234 people related to the status of PTPN II land ownership in Deli Serdang.
In that case, the Supreme Court decided that the 464 hectare land belonged to 234 people or plaintiffs through the Civil Review Decision of the Supreme Court of the Republic of Indonesia Number 508 PK/Pdt/2015 in conjunction with the Decision of the Lubuk Pakam District Court 05/Pdt.G/2011.
The decision is based on the basis of rights in the form of a certificate regarding the distribution and receipt of rice fields / fields dated December 20, 1953.
After losing the civil lawsuit, PTPN II filed a criminal lawsuit with the Lubuk Pakam District Court because it found evidence of falsification of a certificate regarding the distribution and acceptance of rice fields/fields.

On June 27, 2023, the Lubuk Pakam District Court issued Decision Number 471/Pid.B/2023/PN.Lbp which stated that the defendant on behalf of Murachman was not proven to have committed a criminal act of falsifying a certificate regarding the distribution and acceptance of rice fields/fields.
Based on the decision of the Lubuk Pakam District Court, the public prosecutor has filed an appeal on July 6, 2023.
Mahfud said that in the case review he carried out together with representatives of the Attorney General's Office and the North Sumatra High Prosecutor's Office, they found a number of irregularities, including an error in writing the plantation location, namely in Tanjung Merawa District which should have been written by Tandiong Morawa.
"Secondly, in the trial, the witnesses and defendants once admitted that they never owned the land, never saw its origin. They said that they were only whispered by their friends and the plaintiffs felt they did not know where the land was, the 234 people did not know where the land was," said Mahfud.
The irregularities, continued Mahfud, will also be conveyed in the cassation memory.
"This is part of the land mafia, it is clear that the land mafia is so we have to set an example of how to deal with the land mafia," he said.
