Kotim Regency Government Wins Land Lawsuit At Bina Karya Market

KOTIM - The government of East Kotawaringin Regency (Kotim), Central Kalimantan won a civil lawsuit over market land at Bina Karya Housing on Jalan Jenderal Sudirman kilometer 6 Sampit."In its ruling, the panel of judges in the main case stated that the plaintiffs' lawsuits were unacceptable and sentenced the plaintiffs to pay court fees," said Head of the Legal Section of the Regional Secretariat of East Kotawaringin Regency, Pintar Simbolon in Sampit, quoted from Antara, Wednesday, May 31.Pintar said the decision was delivered in an open to the public trial on Monday through the e-court system.The official, who has the background of a prosecutor, explained that the East Kotawaringin Regency Government won a civil case filed by M Tamin as the President Director of PT Bina Karya Permai and Siti Hasiyah as the President Commissioner of PT Bina Karya Permai through her attorney.The object of the lawsuit in this case is a plot of land covering an area of approximately one hectare on which there is a market building, located on Jalan Jenderal Sudirman km 6 of the Bina Karya Sampit Housing Complex.The land is recorded in the inventory card of goods from the East Kotawaringin Regency Industry and Trade Office. In this case, the plaintiffs stated that the East Kotawaringin Regency Government had committed an unlawful act as stated in Article 1365 of the Civil Code.The plaintiffs demanded that the local government hand over the object of the dispute to the plaintiff in an empty state without any burden or reimburse the land rights of Rp. 6,322,000,000.00 plus demands for material and immaterial compensation of Rp. 1 billion.Even though the East Kotawaringin Regency Government won, this is still the first level decision. For this reason, the local government is still waiting for the plaintiff's attitude towards the decision."The plaintiff still has the opportunity to file a legal action in accordance with applicable regulations, however, the team from the Legal Section of the Regional Secretariat of East Kotawaringin Regency is ready and remains optimistic," said Simbolon.Separately, the Regent of East Kotawaringin Halikinnor expressed his highest appreciation for the decision of the Panel of Judges at the Sampit District Court and the optimal efforts of the Legal Section of the East Kotawaringin Regional Secretariat at the trial in order to secure regional assets.Halikinnor also conveyed to all his staff to be more optimal in managing regional property and carrying out security including administrative security, physical security and legal security.Administrative security includes administering ownership documents, not only in the form of land certificates, but also acquisition documents, proof of payment, and minutes of measurement of regional property.Physical security, among others, refreshes property belonging to the area on vacant land that has not or will be used.
"Meanwhile, legal security includes carrying out optimal case handling at every level of the judiciary in terms of lawsuits against regional property," said Halikinnor.
