Restorative Justice Processed, 6 Suspects In Theft Cases To Domestic Violence In Samarinda Free

The Samarinda District Attorney (Kejari) has acquitted criminal suspects six times through restorative justice or restorative justice during the period January to May 2023.

Head of the Samarinda District Attorney's Office, Firmansyah Subhan, said that those who were processed for restorative justice were suspects of theft, persecution, domestic violence (KDRT), to fraud.

"In this period, we have submitted the termination of prosecution based on restorative justice to Jampidum (Junior Attorney General for General Crimes) as many as seven cases, with six of them having been approved so that the suspect is released," he said in Samarinda, East Kalimantan (Kaltim), Tuesday, May 30, confiscated by Antara.

Meanwhile, another case is still in the process of being submitted, namely a fraud case with a suspect BM as regulated in Article 378 of the Criminal Code regarding fraud.

Previously, on Monday, May 29, the Samarinda Kejari conducted an online presentation to the Attorney General's Office for restorative justice approval after the public prosecutor (JPU) brought together the victim and suspect through mediation.

"We support the Attorney General's breakthrough in realizing humanist law enforcement through the settlement of cases outside the court, namely by submitting a termination of prosecution based on restorative justice," he said.

The basis of consideration for the Public Prosecutor in carrying out restorative justice is regulated in the Regulation of the Prosecutor's Office of the Republic of Indonesia Number 15 of 2020 concerning Termination of Prosecution Based on Restorative Justice.

He said that criminal cases can be closed for the sake of law and the prosecution is stopped based on restorative justice, which is the first time a suspect has committed a crime, the threat of imprisonment is no more than five years, and the value of losses incurred is no more than IDR 2.5 million.

In addition, he said, the suspect had recovered by returning the goods to the victim, replacing the victim's losses, replacing the costs incurred, having a peace agreement between the victim and the suspect, and the community responding positively.

"The achievement of performance from January to May is a momentum to reflect on the implementation of the main tasks and functions of the prosecutor's office as one of the law enforcement agencies that carries the breakthrough of Humanist and Modern Law Enforcement," he said.
