The KPK Notice Makes The Secretary General Of The House Of Representatives Open A Voice On The Tender For The Procurement Of Curtains

JAKARTA - The Corruption Eradication Commission (KPK) was asked to investigate potential irregularities in the tender for the procurement of curtains for the DPR's official residence amounting to IDR 43.5 billion. The reason is that the tender for the curtains was won by a company that actually offered a high price.

Criticism of the curtain procurement previously came from various groups, including Formappi, MAKI, to the PAN faction of the DPR RI. In fact, the BURT of the DPR will also summon the Secretary-General of the DPR for questioning.

Responding to this, the KPK warned the Secretary-General of the DPR RI that the process of procuring goods and services must refer to the provisions in Presidential Regulation No. 12 of 2021 concerning amendments to Presidential Regulation No. 16 of 2018 concerning Government Procurement of Goods/Services, so that the process management does not violate the rules.

"The KPA and PPK procurement must ensure that the entire process is in accordance with procedures, considering that the procurement of goods and services is one of the modes that are prone to corruption," said Acting KPK spokesman, Ali Fikri, in a statement to reporters, Monday, May 9.

The KPK also urges all stages of the curtain procurement process to be carried out in a transparent and accountable manner, in order to prevent certain parties from using them to take personal advantage in ways that violate the law.

"The principles of transparency and accountability are a form of accountability for the use of the APBN/APBD by each ministry, regional government, BUMN/BUMD, and other institutions that manage state finances," said Ali Fikri.

It is known that the tender for the replacement of curtains at the official house of the DPR RI members was won by the bidder who offered a price of IDR 43.5 billion.

Judging from the DPR RI LPSE website, the auction was won by PT Bertiga Mitra Solusi, which is located in Tangerang, Banten.

The company won the auction which was attended by 49 participants. However, on the DPR LPSE website, only the bid prices of the three bidders can be seen.

Among them, PT Sultan Sukses Mandiri with an offer of IDR 37,794,795,705 (IDR 37.7 billion), PT Panderman Jaya with IDR 42 149,350,236 (IDR 42.1 billion), and PT Bertiga Mitra Solusi with an auction offer of IDR 43,577,559,594.23 (IDR 43.5 billion).

Meanwhile, the corrected price and the negotiated price for this tender remain the same as the figure offered by PT Bertiga Mitra Solusi as the winner of the tender, which is IDR 43.5 billion.

The Secretary-General of the House of Representatives Reasoned Only the Winner of the Tender with the Highest Price Passed the Qualifications

The Secretary-General (Secretary-General) of the DPR RI, Indra Iskandar, finally opened his voice regarding the polemic of the winner of the tender for the curtains for the official house of DPR members with the highest bid of IDR 43.5 billion.

Indra explained that the current curtains, vitrases, and blinds at RJA Kalibata and RJA Ulujami are the result of the procurement or auction process for Fiscal Year 2010. Thus, they have been used for 12 years, so many are rotten and damaged.

"Since 2020, there have been many requests from members of the council to the Secretariat General to replace the curtains, curtains, and blinds in RJA units, which are no longer in proper condition," Indra said in a press statement to reporters, Monday, May 9.

However, Indra continued, the Secretariat General of the DPR could not fulfill the request of the said council members because there was no budget allocation yet.

"In the 2022 Fiscal Year, a new budget allocation was obtained for the replacement of curtains, curtains, and blinds. However, it can only be allocated for 505 units of RJA Kalibata," he explained.

Indra then revealed the chronology of the procurement of curtains for the DPR member's official residence. According to him, the tender for the curtains and blinds for the DPR for the 2022 Fiscal Year will start on March 8, 2022, with an HPS value of IDR 45,767,446,332.84.

Indra said that 49 companies registered to participate in the tender. At the stage of explaining the work carried out on March 14, 2022, there were 16 questions asked by prospective providers of goods and services.

"At the stage of opening a response bid on March 21, 2022, of the 49 companies participating in this tender, only three companies submitted bids," he said.

The three companies that submitted bids to participate in the tender for the procurement of curtains for the official residence of members of the DPR are PT. Sultan Sukses Mandiri with an offer price of IDR 37,794,795,705.00 or below the HPS 10.33 percent, PT. Panderman Jaya with an offer price of IDR 42,149,350,236.00 or below HPS 7.91 percent, and PT. Bertiga Mitra Solusi with an offer price of IDR 43,577,559,594.23 or below the HPS 4.78 percent.

According to Indra, at the administrative evaluation stage, two bid letters met the requirements in accordance with the stipulated tender documents, namely, PT. Sultan Sukses Mandiri and PT. Bertiga Mitra Solusi passed. While PT. Panderman Jaya was declared unsuccessful.

"Technical qualification requirements are carried out for companies that have passed the administrative evaluation to be evaluated," he said.

Indra said that the evaluation carried out in technical research was the factor required in the tender document. According to him, if the technical evaluation results do not meet the requirements, then the bid is declared technically unsuccessful, and will not be evaluated further and declared void.

"If the results of the assessment meet the requirements, then the bid is declared technically passed and has the right to be included in the cost evaluation," he said.

After administrative, technical, and price clarifications were made to PT. Sultan Sukses Mandiri and PT. Bertiga Mitra Solusi on April 1, 2022, the results obtained that PT. Sultan Sukses Mandiri was declared incomplete because he did not attach the experience of 50 percent of the value of HPS in the last 10 years. While PT. Bertiga Mitra Solusi was declared complete.

"After proving the qualifications on April 4, 2022 in accordance with the minutes of clarification of the bid documents that the provider PT. Bertiga Mitra Solusi has passed," he said.

Meanwhile, Indra added, on April 5, 2022 at 08.00 western Indonesia time, the committee will determine and announce the winner.
