AGO Executes Corruption Replacement Money For PT IM2 Rp1.35 Trillion

JAKARTA - The Attorney General's Office executed a criminal verdict of Rp 1.35 trillion in compensation from the convict Indar Atmanto, which was charged to PT Indosat Mega Media (IM2).

The execution of the penalty for compensation in the case of corruption in the 3G frequency band network involving Indosat's subsidiary, PT IM2, has been carried out by the Executing Prosecutor's Team for the South Jakarta District Attorney.

"The execution will be carried out on Monday, November 29, 2021," said the Head of the Attorney General's Office for Legal Information, Leonard Eben Ezer Simanjuntak, in a written statement received in Jakarta, Thursday, December 2.

This execution was based on the Decision of the Supreme Court of the Republic of Indonesia Number: 787 K/PID.SUS /2014 dated July 10, 2014 jo. Decision of the DKI Jakarta High Court Number: 33/PID/TPK/2013/PT.DKI dated December 12, 2013 Jo. Decision of the Corruption Court at the Central Jakarta District Court Number: 01/Pid.Sus/TPK/2013 dated July 8, 2013, on behalf of the convict Indar Atmanto, former Director of IM2.

Including, based on the Order for Executing the Decision of the South Jakarta District Prosecutor's Office Number: Print-412/M.1.14/Fu.1/05/2021 Dated May 7, 2021, in conjunction with the Warrant for Searching the Property of the Convicted South Jakarta District Attorney Number: Print-102 /M.1.14/Ft.1/05/2021 May 11, 2021.

Leonard explained that the executor's prosecution team confiscated IM2's assets to pay the replacement money.

The confiscated assets included the IM2 Building which stands on a land area of 24,440 m2 located in Ragunan Village, South Jakarta. Another building on Jalan H Niih, Ragunan Village with an area of 788 m2 was also confiscated.

Then, as many as 14 units of four-wheeled motorized vehicles and six units of two-wheeled motorized vehicles. A total of 79,280 items of production assets (optical cables, servers, etc.) belonging to PT. Indosat Mega Media (IM2).

The next assets seized were 1,228 items of production support assets (production equipment for the provision of communication services) belonging to IM2. A total of 258 items of inventory in the form of furniture belonging to PT IM2.

The executing prosecutor also confiscated mechanical electric (genset, UPS, etc.) supporting the office building belonging to PT IM2.

There was also money amounting to Rp7.7 billion, money in US dollars of 72.87 US dollars through RPL Account 139 of the South Jakarta District Attorney. Receivables from PT IM2 with a total value of Rp

"Furthermore, a price assessment (taxation) will be carried out," said Leonard.

Leonard added that during the execution of the confiscation, PT Indosat Tbk submitted an application to be able to disintegrate the Indosat network installed in the PT IM2 Building until the end of March 2022.

Network disintegration is carried out by relocating BSC/RNC 720 BTS 2G, 890 BTS 3G, and 361 BTS 4G transmission devices for 4,097,000 subscribers.

If this is not done, it will result in the absence of internet and telephone services to customers, namely the general public, government agencies, essential and critical industries such as banking, health, and education services in the DKI Jakarta Province.

"The Board of Directors of PT. Indosat Tbk has signed a statement letter on December 1, 2021," Leonard said.

The statement letter provides assurance that PT. Indosat Tbk is willing to fulfill obligations, among others, regarding the use of electricity, use of generators, security, cleaning, and maintenance technicians during the network disintegration process.

The corruption case is related to the illegal cooperation between PT Indosat and IM2 in providing internet on the 2.1 gigahertz (GHz) frequency.

IM2 was reported by consumers for abusing the 2.1 GHz frequency band even though the cellular operator had no right to operate on the network. In addition, IM does not pay taxes to the state for frequency usage which results in state losses of Rp1.35 trillion.

Indar Atmanto was sentenced to eight years in prison and a fine of Rp800 million. Meanwhile, IM2 was sentenced to a fine of Rp1.358 trillion in compensation.
