Sri Mulyani Chose To Remain Silent When Asked By The Media About The Unconstitutional Copyright Act

JAKARTA - The Ministry of Finance chose not to respond to questions from the media crew regarding the decision of the Constitutional Court (MK) which stated that the Job Creation Act or Ciptaker contradicted the 1945 Constitution of the Republic of Indonesia.

In fact, this issue became the question that the media had been waiting for the most when the Minister of Finance, Sri Mulyani, held a virtual press conference on our State Budget on Thursday evening. In addition to the Minister of Finance, the Deputy Minister of Finance, Suahasil Nazara, and Echelon One officials in the Ministry of Finance were also present on the agenda.

The opportunity to get a response regarding the Ciptaker Law case finally had to be lost when the question and answer session ended, which was followed by the closing of the press conference on our State Budget for the November period.

As is known, the Constitutional Court considers that the Job Creation Law does not have conditionally binding legal force.

"Contrary to the 1945 Constitution of the Republic of Indonesia and has no conditional binding legal force as long as it is not interpreted as 'no repairs have been made within 2 years since this decision was pronounced'," said Chief Justice of the Constitutional Court, Anwar Usman, while reading the verdict which was broadcast live on the YouTube channel of the Indonesian Constitutional Court, Antara, Thursday, November 25.

However, the regulations that were born in the era of the pandemic are still in effect while making improvements within a maximum period of 2 years from the time the decision was made.

If within that time limit the legislators do not make improvements, the Job Creation Act becomes permanently unconstitutional.
