MA Discounts Rizieq Shihab's 2-Year Sentence In The Case Of Ummi Hospital, Habib Husin Values Bad Judicial Precedent

JAKARTA - Secretary-General for the Eradication of the Legal Mafia (PMH), Husin Alwi Shihab, spoke about the Supreme Court discounting Rizieq Shihab's sentence to 2 years in the case of spreading false news of swab test results at the Ummi Hospital in Bogor.

The Supreme Court's decision is 2 years lower than the decision of the East Jakarta District Court which sentenced the former high priest of the Islamic Defenders Front (FPI) to 4 years in prison.

"This will set a bad precedent for our judiciary", said Husin Alwi, quoted from his personal Twitter, @HusinShihab, Tuesday, November 16.

According to Husin, the article that ensnared Rizieq Shihab, namely Article 14 paragraph 1 of the Republic of Indonesia Law Number 1 of 1946 concerning the Criminal Law Regulation in conjunction with Article 55 paragraph 1 of the Criminal Code was made with a strong philosophy so that this country would not be destroyed because of slander.

"Why are articles 14 & 15 of Law No. 1 of 1946 sanctioned for 10 years, because it has a strong philosophy so that this country will not be destroyed quickly because of slander. Habib Rizieq Shihab's sentence is reduced, now it's 2 years in prison", explained Husin.

The decision of the Supreme Court to reduce Rizieq Shihab's sentence to 2 years is stated in the verdict made today.

"Improve the decision of the East Jakarta District Court number 210/Pid.Sus/2021/PT dated August 30, 2021, which amends the decision of the East Jakarta District Court number 225/Pid.Sus/2021/East Jakarta District Court dated June 24, 2021, reducing the sentence imposed on The defendant is sentenced to 2 years in prison", the verdict read.
