The European Union Allows Social Media Giants To Save Citizens' Data In The US In New Agreements

JAKARTA - The European Union (EU) has finally given final approval to adopt a safe data transfer agreement to the United States (US).

The agreement, entitled UE-US Data Privacy Framework includes the ability of thousands of businesses, including social media giants, to easily transfer EU citizens' personal information to servers located in the US.

"Based on a new adequacy decision, personal data can flow safely from the EU to US companies participating in the Framework, without having to apply additional data protection protection," the EU Commission said in its official statement, quoted Tuesday, July 11.

The EU-US Data Privacy Framework introduces new binding safeguards to address all issues posed by the European Court.

This includes limiting access to EU data by US intelligence services for what is necessary, proportionate and establishing a Data Protection Review Court (DPRC), which is accessible to EU citizens.

The DPRC can also order to delete the data if data is found to have violated the new protection.

"US companies will be able to join the EU-US Data Privacy Framework by committed to complying with a series of detailed privacy obligations," the EU Commission said.

"Such as the requirement to delete personal data if it is no longer needed for collection purposes and to ensure the continuity of protection when personal data is shared with third parties," he added.

Meanwhile, EU residents will receive compensation if their data is wrongly handled by US companies. The DPRC will independently investigate and resolve the complaint.

In addition, the EU-US Data Privacy Framework also provides a number of protections related to access to transferred data based on the framework by US public authorities, particularly for the purpose of enforcing criminal law and national security.

Finally, the EU-US Data Privacy Framework will be regularly reviewed by the EU Commission, along with representatives of European data protection authorities and US authorities.
